Motion by Mayor Garnet, seconded by Councilmember Hendrikgen, to table action until March 12, 2002, and direct staff to draft findings of fact in the positive and negative. Further discussion: City Attorney Goodrich noted that, if the applicant agrees to extend the 60- day rule, the applicant could meet with the residents to develop a plan. Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Anderson, and Zimmennan. Voting No: None. Abstained: CouncilmemberKurak Section 28 Principal Platmer Trudgeon stated that the City received a request to change the land use from "Places to Work" to "Mixed Use". The Planning Commission recommended the land use change unanimously. Councilmember Hendriksen stated that the map does not reflect the staging of the property. Principal Planner Trudgeon replied that the map does indicate phasing rings. City Attorney Goodrich inquired if the text addressed the phasing. Principal Planner Trudgeon replied yes. Councihnember Kurak verified that they were only talking about the eastern portion of Section 28. City Attorney Goodrich replied that they are not dealing with the Kurak property so Councihnember Kurak could vote on the amendment Councilmember Hendriksen inquired if they change #12, would any construction in the area be subject to the tiering discussed on page 307 of the agenda. City Attorney Goodrich replied yes. Principal Planner Trudgeon noted that the language would have to be included in the zoning code. Councilmember Hendriksen inquired if there is sufficient language that would say that #12 would not be developed in advance of the town center. Principal Planner Trudgeon reviewed the language pertaining to the tiering phases. Councilmember Kurak inquired if the phasing is a moratorium on the property.
