<br />Councilmember LeTourneau introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #17-11-288 <br /> <br />RESOLUTION RELEASING PREVIOUSLY APPROVED ALLOCATION AGREEMENT <br />BETWEEN THE CITY AND D.R. HORTON, INC AS WELL AS RELEASING AN <br />ALLOCATION AGREEMENT AND A SECONDARY DEVELOPMENT CONTRACT <br />BETWEEN THE CITY AND K. HOVNANIAN T&C HOMES AT MINNESOTA L.L.C, <br />FOR SUBJECT PROPERTY TO BE DEVELOPED AS GREENWAY TERRACE <br /> <br /> WHEREAS, <br /> The City of Ramsey, is a party to an Allocation Agreement recorded as <br />Document Number 1891854, an Allocation Agreement recorded as Document No. 1977751.010, <br />th <br />and a Secondary Development Contract for Ramsey Town Center 7 Addition, Symphony at Town <br />Center, recorded as Document No. 1977751.011 (collectively, the Subject Documents); and <br /> <br />WHEREAS <br />, the Subject Documents concern the parcel of property legally described as <br />follows: <br /> <br />th <br />Outlot A, Ramsey Town Center 7 Addition, Anoka County, Minnesota. <br /> <br /> (the “Subject Property”); <br /> <br />WHEREAS, <br /> the City is selling the Subject Property and the buyer(s) wish to have the <br />Subject Documents released by the City to clear title; and <br /> <br />WHEREAS, <br /> the obligations owed to the City pursuant to the Subject Documents, as those <br />documents concern the Subject Property, have been fulfilled or are otherwise no longer in need of <br />enforcement by the City. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY , STATE OF MINNESOTA, as follows: <br /> <br />That the Ramsey City Council hereby releases the Subject Documents to the extent the Subject <br />Documents affect or concern the Subject Property. The Mayor and City Administrator are hereby <br />authorized to execute any additional documentation necessary to effectuate this release. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Johns, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br /> Mayor Strommen <br /> Councilmember LeTourneau <br /> Councilmember Johns <br /> Councilmember Kuzma <br /> Councilmember Shryock <br /> <br />and the following voted against the same: <br /> <br /> None <br /> <br />
