Councilmember introduced the following resolution and moved for its adoption: 'RESOLUTION #04-12- A RESOLUTION ADOPTING FINDINGS OF' FACT #0 RELATING TO A REQUEST FOR A CONDITIONAL USE PERMIT TO OPERATE A RESTAURANT DRIVE-UP WINDOW IN THE TC-2 ZONING DISTRICT. WHEREAS, Ramdance LLC, hereinafter referred to as the "Applicant," has properly applied for a Conditional Use Permit to operate a restaurant drive-up window in the Pond Building located in the TC-2 Zoning District on property legally described as follows: Outlot I, Ramsey Town Center Addition, Anoka County, Minnesota; Or upon recording Lot 1, Block 1, Ramsey Town Center 3ra Addition. ("Subject Property") NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE.OF MINNESOTA .that the findings of fact relating to the request are determined to be as follows: That the Applicant appeared before the Planning Commission for a public hearing pursuant to Section 9.14.04 of the Ramsey City Code on December. 2, 2004, and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated by reference. That the Applicant has submitted a site plan to construct a 9,200 square-foot multi-tenant restaurant building, referred to as the Pond Building, within the Ramsey Town Center development. 3. That the Subject Property is approximately nine (9) acres in size.- 4. That the Ramsey City Council adopted the Town Center Zoning District on September 23, 2003. 5. That the Subject Property is zoned TC-2 and is located inside the urban service area. (MUSA). 6. That the TC-2 Zoning District states that buildings with drive-thru features are only permitted as a conditional use within the District.
