Councilmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #04-12- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF.A CONDITIONAL USE PERMIT <br />TO RAMDANCE, LLC TO OPERATE A RESTAURANT DRIVE-UP WINDOW AS <br />PART OF THE POND BUILDING IN RAMSEY TOWN CENTER 3a~ ADDITION IN <br />THE TC-2 ZONING DISTRICT AND DECLARING TERMS OF SAME: <br /> <br /> WHEREAS, Ramdance, LLC, hereinafter referred to as the "Pemittee," has properlY <br />applied for a Conditional Use Permit to operate a restaurant drive-up window as part of the Pond <br />Building in Ramsey Town Center .3rd Addition in the TC-2 Zoning District on property legally <br />described as follows: <br /> <br />Outlot I, Ramsey Town Center Addition, Anoka County, Minnesota; <br /> <br />Or upon recording <br /> <br />Lot 1, Block 1, Ramsey Town center 3rd Addition. <br /> <br /> ("Subject Property") <br /> <br /> WHEREAS, the Planning Commission met on December 2, 2004, conducted the <br />public hearing and recommended City Council.approval of the reqUest. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL' OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact #0 , a Conditional Use Permit (Permit) to'operate a restaurant <br />drive-up window as part of the Pond Building in Ramsey Town Center 3rd Addition in the <br />TC-2 Zoning District, is hereby granted to the Permittee. <br /> <br />That the Permit only applies to the drive~up window that will be a part of the Pond Building <br />restaurants to be located on the prOposed Lot 1, Block 1' of Ramsey Town Center 3rd <br />Addition. <br /> <br />That the Permit only allows for the use of the drive-up window to support restaurant <br />operations contained within the Pond Building. <br /> <br />That the area of the drive-up window shall only be located as shown on the proposed site plan <br />for the Pond Building. Any relocation of the drive-Up window shall be reviewed and <br />approved by the City Council. <br /> <br /> <br />
