CASE # <br /> <br /> REQUEST TO REZONE CERTAIN PROPERTY <br />FROM R-2 MEDIUM DENSITY RESIDENTIAL TO TOWN CENTER-4A; <br />CASE OF BRIGHTKEYS, INC. <br /> By: Amy Geisler, Associate Planner <br /> <br />Background: <br /> <br />Brightkeys, Inc. has requested that the City consider rezoning a portion of their property from R- <br />2 Medium Density Residential to Town Center - 4a in order to allow for 'a subdivision of their <br />land. -. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Sketch plan of Town Center Gardens 3rd Addition <br />c) Planning Commission meeting minutes dated November 4, 2004. <br />d) Proposed Findings of Fact <br /> <br />Notification: <br /> <br />State statute requires that property owners within 350 feet of the subject property be notified of <br />the public hearing. Notice was sent out to property owners within 700 feet of'the Subject <br />Property. <br /> <br />Observations: <br /> <br />As discussed in the previous Comprehensive Plan Amendment case, the applicant has submitted <br />a revised sketch plan based on input received at the 'August 5th and November 4th Planning <br />Commission meetings. The revised sketch plan shows the area under conSideration for the <br />rezoning (Zone A) to be compatible with'the adjacent Town Center development in both design <br />and density.-In order for this to occur, a Comprehensive Plan Amendment to change the subject <br />property's land use coupled with a rezoning to Town Center 4a (TC-4a) is necessary. The TC-4a <br />Zoning District allows up to 10 residential units per acre. <br /> <br />Recommendation: <br /> <br />Because of the revisions that have been made to the Town Center Gardens 3rd Addition sketch <br />plan, and the current and planned land use designation on adjacent properties, the Planning <br />Commission and Staff recommend approval of the rezoning request from R-2 to TC-4a. <br /> <br /> <br />
