Councilmember introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #04-12- <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT # TO <br />PROPERTY FROM R-2 MEDIUM DENSITY RESIDENTIAL <br />CENTER <br /> <br />REZONE CERTAIN <br />TO. TC-4a TOWN <br /> <br /> WHEREAS, on November 11, 2004, the City received an application to rezone certain <br />property in accordance with Section 9.03.03 of the Ramsey City Code. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That Brightkeys, Inc, hereinafter referred to as "Applicant," has properly applied to <br /> rezone certain property from R-2 Medium' Density Residential to TC-4a Town Center. <br /> <br />That the Planning Commission conducted a public hearing pursuant to Section 9.03.03 of <br />the City Code on November 4, 2004 and said public hearing was properly advertised, and ' <br />the minutes of said public hearing are hereby incorporated by reference. <br /> <br />3. That the property proposed to be rezoned is legally described as follows: <br /> <br />Outlot B, Town Center Gardens 2nd Addition, and the South 310 feet of Outlot C, <br />Town Center Gardens, Anoka County, Minnesota <br /> <br />4. That the area of the property to be rezoned is approximately 7.83 acres in size. <br /> <br />5. That the Subject Property is currently zoned R-2 Medium Density Residential and is <br /> located within the boundaries of the current Metropolitan Urban Service Area (MUSA). <br /> <br />6. That the Comprehensive Plan designates the property for Medium Density Residential <br /> development. <br /> <br />7. That the Applicant has submitted a Comprehensive Plan Amendment to change the land <br /> use designation in the Comprehensive Plan'to Mixed Use. <br /> <br />8. That the proposed zoning amendment will not substantially adversely impair the use or <br /> market value of any surrounding propertyl <br /> <br />9. That the proposed zoning amendment will 'not change the essential character of the area,. <br /> which is commercial. <br /> <br />10. That the existing road infrastructure will be capable of accommodating, in a safe manner, <br /> the additional traffic to be generated by the rezoned property. <br /> <br /> <br />
