October 10, 2017 I Volume 11 I Issue 19 Zoning Bulletin <br />ILLINOIS <br />A new state law "protect[s] individuals who speak out at public zon- <br />ing appeal hearings from being sued." The new law, Senate Bill 731, <br />"clarifies that only the zoning board of appeals and applicants that come <br />before the board are considered a `party of record' " that can be named <br />as defendants in court cases where a plaintiff seeks administrative <br />review of a zoning decision. The Office is to be composed of a Director of Nightlife, <br />"who will serve as a representative for independent and DIY spaces as <br />well as a liaison between the nightlife industry and City Hall," as well <br />as a Nightlife Advisory Panel to be composed of individuals who are <br />industry service workers and zoning experts. Among other things, the <br />touted purpose of the Office of Nightlife is "to resolve ongoing issues <br />between New York's DIY venues and residential communities, advocate <br />for the protection and preservation of these spaces, and challenge the <br />extreme measures that are posed against them by law enforcement." <br />Source: The Fader; www thefader.com <br />TEXAS <br />State Rep. Roland Gutierrez has filed a bill, HB 362, "that would cre- <br />ate a military zoning board in order to regulate development for 5 miles <br />around military bases." The bill has reportedly been filed in direct re- <br />sponse to two bills in the House and Senate (SB 6 and HB 6) that would <br />"overhaul the state's annexation law." Under those bills, cities would be <br />prevented from unilaterally annexing unincorporated areas. Military <br />and city officials reportedly "fear these annexation bills could put <br />military 'bases at risk for closure if land use around them can't be <br />regulated."
