Regular Planning Commission 6. 2. <br />Meeting Date: 12/07/2017 <br />By: Chris Anderson, Community <br />Development <br />Information <br />Title: <br />Review Resubmitted Concept of Shade Tree Cottages; Case of Shade Tree Communities <br />Purpose/Background: <br />Shade Tree Communities has contacted the City and expressed a desire to resubmit a proposed plat known as Shade <br />Tree Cottages . This is a project that went through City review approximately ten (10) years ago and received final <br />plat and site plan approval as well as a zoning amendment to rezone the parcel to Planned Unit Development <br />(PUD). The project is a mix of small -lot single-family and detached townhomes (villas/detached single-family with <br />HOA maintenance). <br />Notification: <br />Observations/Alternatives: <br />While the final plat and site plan have long since expired, the approval of the Zoning Amendment to Planned Unit <br />Development, allowing certain deviations such as narrower roads, narrower lot widths, and a longer cul-de-sac, are <br />still valid as the City never considered a subsequent Zoning Amendment to revert back to the underlying Zoning <br />District of R-1 Residential (MUSA). Staff has verified that the Developer does possess certain entitlement to the <br />project, although it needs to go through the subdivision process again. Of note, current standards related to lot depth <br />and wetland setbacks would have considerably altered the proposed development had it been brought forward <br />today needing PUD approval. <br />The Developer is making an attempt to revise the concept to better comply with current regulations. For example, <br />the Developer is attempting to account for the current 16.5 foot wetland setback. <br />While the Planning Division has not yet received an updated Sketch Plan, Staff has attached the plan set that had <br />originally been submitted over ten (10) years ago at least as a starting point. The intention would be to host a public <br />workshop on January 4, 2018 and then discuss the project with the Planning Commission that same evening. Staff <br />will be reviewing in more detail with the entire Staff Development Review Team in early December. <br />In summary, it is likely that the Developer can propose the attached concept without the need for a Zoning <br />Amendment, as the site is currently within a Planned Unit Development District based on this layout. <br />Funding Source: <br />Staff is handling this portion of the review as part of normal Staff duties. <br />Recommendation: <br />Staff has no recommendation at this time since a formal application and plans have not been received. <br />Action: <br />No action requested at this time. <br />Attachments <br />
