Councilmember Hendriksen stated that the language he recommended be included as a condition <br />refers to a particular business and inquired if that was appropriate since a conditional use permit <br />exists with the property as long as the conditions exist. <br /> <br />City Attorney Goodrich replied that the conditional use permit should state what H & L Mesabi <br />does. <br /> <br />Councilmember Hendriksen stated that he was trying to avoid a conditional use permit that runs <br />forever and goes from an acceptable use to an unacceptable use. He questioned if they were <br />unable to limit the conditional use permit to a particular business name. <br /> <br />City Attorney Goodrich replied that the conditional use permit should not state the business <br />name. <br /> <br />Councilmember Hendriksen recommended adding the following language as condition #9: <br />"That all new and used equipment being stored on the property must be in operating condition <br />and the storage of junk, debris and inoperable equipment will not be permitted." <br /> <br />Motion by Councilmember Zimmerman, seconded by Councilmember Hendriksen, to adopt <br />Resolution #02-05-112A approving the conditional use permit request, adding condition #9, and <br />based on the findings of fact. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Hendriksen, <br />Anderson, and Kurak. Voting No: None. <br /> <br />Case #9: <br /> <br />Request for a Conditional Use Permit to Exceed Sign Size Restrictions; Case <br />of Bob Muller, Rum River Plaza <br /> <br />Community Development Director Frolik stated that the City received an application from Bob <br />Muller requesting a conditional use permit to exceed sign size restrictions for Rum River Plaza <br />lnulti-tenant retail center located at 5923 - 167' Avenue. In the commercial district, City Code <br />restricts ground or fi'eestanding signs to a size of 100 square feet per side (200 square feet total <br />surface area). Bob Muller owns Rum River Plaza, which is a multi-tenant retail center that <br />houses approximately 14 different businesses. The property currently contains a 91 square foot <br />(182 aggregate surface area) freestanding pylon sign. Bob Muller is requesting additional sign <br />space of 54 square feet per side in order to install a reader board onto the existing pylon sign. <br />The total proposed sign size is 145 square feet (an aggregate surface area of 290 square feet). <br />The applicant has stated the need for additional signage is to provide adequate advertising space <br />for all tenants. The installation of the reader board will not cause the sign to exceed the 25-foot <br />sign height restriction established in City Code. The City has, in the past, granted conditional <br />use permits for extra signage at other multi-tenant buildings such as River's Bend Plaza, Ramsey <br />Town Square, and M&G Leasing. The Planning Commission conducted a public hearing on <br />May 2 regarding the request for additional sign space. There were no verbal or written <br />comments submitted at the hearing.
