STREET IMPROVEMENT FOR 15~TH AVENUE AND HEMATITE STREET By: Pete Raatikka, City Engineer Case # 1 Background: On August 15, 1988 the City council held a public hearing on the proposed street improvement for 156th Avenue and Hematite Street. Since that hearing the City has received a petition from five residents on Hematite Street opposing the project. I have reviewed the petition opposing the project and the original petition requesting the project and find that the number of separate landowners is equal in each petition. Therefore, based on the City Charter and the City Attorney's opinion, the Council cannot proceed with the project. I would like to point out that prior to and at the time of the public hearing, Mr. Terry Hendriksen voiced his concerns over an. on-going drainage problem in the area approximately 500 feet east of Ramsey Boulevard and 156th Avenue N.W. This problem has been brought to the council several times over the past six years and culverts have been installed under 156th Avenue. As indicated in the street feasibility study, the area lacks a positive outlet. Should the City decide to correct the existing drainage problem, it is anticipated that this could be completed as a Rum River Storm Sewer Taxing District Project. The first step in completing the drainage project would be to order a feasibility study. Enclosed are the following items for your information: a) Original petition dated May B1, 1988. b) Petition opposing the project received on August 25, 1988o c) Letter dated July 30, 1988 from Mr. Terry Hendriksen. d) Letter dated August 2, 1988 from Mr. Terry Hendriksen. e) Resolution ordering feasibility study for a positive drainage outlet. Recommendation: I would recommend that the City Council pass a motion accepting the petition opposing the street improvement and direct City staff to send out notices to the residents stating ~that the project has been dropped based on the City Charter. I would also recommend that the City Council adopt the enclosed resolution ordering a drainage study for the area east of Ramsey Boulevard adjacent to 156th Avenue.
