STREET IMPROVEMENT FOR 15~TH AVENUE <br /> AND HEMATITE STREET <br /> By: Pete Raatikka, City Engineer <br /> <br />Case # 1 <br /> <br />Background: <br /> <br />On August 15, 1988 the City council held a public hearing on the <br />proposed street improvement for 156th Avenue and Hematite Street. <br />Since that hearing the City has received a petition from five <br />residents on Hematite Street opposing the project. <br /> <br />I have reviewed the petition opposing the project and the original <br />petition requesting the project and find that the number of separate <br />landowners is equal in each petition. Therefore, based on the City <br />Charter and the City Attorney's opinion, the Council cannot proceed <br />with the project. <br /> <br />I would like to point out that prior to and at the time of the public <br />hearing, Mr. Terry Hendriksen voiced his concerns over an. on-going <br />drainage problem in the area approximately 500 feet east of Ramsey <br />Boulevard and 156th Avenue N.W. This problem has been brought to the <br />council several times over the past six years and culverts have been <br />installed under 156th Avenue. As indicated in the street feasibility <br />study, the area lacks a positive outlet. Should the City decide to <br />correct the existing drainage problem, it is anticipated that this <br />could be completed as a Rum River Storm Sewer Taxing District Project. <br />The first step in completing the drainage project would be to order a <br />feasibility study. <br /> <br />Enclosed are the following items for your information: <br /> <br />a) Original petition dated May B1, 1988. <br />b) Petition opposing the project received on August 25, 1988o <br />c) Letter dated July 30, 1988 from Mr. Terry Hendriksen. <br />d) Letter dated August 2, 1988 from Mr. Terry Hendriksen. <br />e) Resolution ordering feasibility study for a positive drainage <br /> outlet. <br /> <br />Recommendation: <br /> <br />I would recommend that the City Council pass a motion accepting the <br />petition opposing the street improvement and direct City staff to send <br />out notices to the residents stating ~that the project has been dropped <br />based on the City Charter. <br /> <br />I would also recommend that the City Council adopt the enclosed <br />resolution ordering a drainage study for the area east of Ramsey <br />Boulevard adjacent to 156th Avenue. <br /> <br /> <br />
