PROPOSED FINDINGS OF FACT <br />REQUEST FOR REZONING <br />THORP FINANCE CORPORATION <br /> (RIVERSIDE WEST) <br /> <br />That Thorp Finance Corporation hereinafter referred to as <br />"Applicant" has properly applied for a rezoning of the properties <br />at 138th Avenue and Dolomite Street N.W. from B-1 Business to R- <br />1U Residential. <br /> <br />That the Applicant appeared before the Planning and Zoning <br />Commission for a public hearing pursuant to Section 170.013C of <br />the City Code on November 1, 1988 and that said public hearing was <br />properly advertised and that the minutes of said public hearing <br />are hereby incorporated by reference. <br /> <br />That the properties which are the subject of the application are <br />located at 138th Ave. and Dolomite St. N.W. and are legally <br />described as follows: <br /> <br />Lots 2 and 3, Block 5, Riverside West, Anoka County, <br /> Minnesota. <br /> <br />That Lot 2 is approximately 1 acre in size and Lot 3 is <br />approximately 1.25 acres in size. <br /> <br />5. ~.ha~-~ the subject properties° are currently zoned B-1 Business. <br /> <br />6. That the property to the south is zoned R-1U Residential. <br /> <br />That the property to the north of Lot 2 is zoned B-! Business and <br />is developed with a church structure. <br /> <br />$. That the properties to the east are zoned B-! Business. <br /> <br />That the property to the west of Lot 2 is zoned B-! Business and <br />the property west of Lot 3 is zoned R-1U Residential. <br /> <br />!0. That the Applicant has stated that the rezoning is necessary since <br /> the properties have not been able to be sold for commercial <br /> development. <br /> <br />__.~ ='~na.~ the rezoning will not substantially adverse!v, imoair, the use <br /> cr market value cf any surrounding property· <br /> <br />!2 m',-, - ~- <br /> . _.~=~ the proposed rezoning will be in accordance w~n'~' the specific <br /> objectives of the Comprehensive Plan· <br /> <br />_~3. ~-~_.~ the oroposed, razoning will not change the essential character <br /> cf the area. <br /> <br />!4.' Thzt the use cf Let 2 as a residential use may cause adjacent B-! <br /> properties to incur additional costs due to screening requirements <br /> between B-! & R-! uses unless these req/uirements are waived. <br /> <br />! <br /> <br /> <br />
