PROPOSED FINDINGS OF FACT 1~. STAI'~LE¥ MO£TON That Mr. Stanley Morton, hereinafter referred to as "Applicant", has properly applied for a conditional use permit to have an advertising sign. That the Applicant appeared before the Planning and Zoning Commission for a public hearing pursuant to Sections 170.013D and 170.05 of the City Code on November 1, 1988 and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as part of these findings by reference. 3. That the subject property is generally kn~'n as 16355 St. Francis Blvd. N.W. and is legally described as follc~,s: That part of the north half of the northeast quarter of Section 14, Township 32, Range 25, Anoka County, Minnesota described as follows: Commencing at the intersection of the north line of said Section 14 with the center line of State Trunk Highway No. 47 as the same is now laid out and traveled, said point being 762.3 feet east from the north quarter corner of said Section 14, then south 3 degrees 05 minutes east along the center line of said highway a distance of 420 feet, then south 89 degrees 52 minutes east a distance of 894.39 feet, then north 0 degrees 19 minutes east a distance of 419.74 feet, then north 89 degrees 52 minutes west a distance of 910.40 feet to the actual point of beginning (ezcept the west 313 feet thereof as measured along the north and south lines thereof) for the purpose of this description, the north line of said Section 14 is assumed to have a bearing of east and west. 4. That the subject property is located in the R-IR Residential District and is approximately 10 acres in size. 5. That the Applicant was granted a conditional use permit in 1981 to operate a nursery stock sales lot on the subject property. 6. That one of the conditions of the permit issued in 1981 is that any installation of signs shall be in compliance with local ordinances. Section 170.05 of the F~msey City Code prohibits advertising signs in R-iR Residential Districts. Section 170.05 also states that conditional use per-mits are required for all advertising signs. That the Applicant has stated that such conditional use permit is necessary to properly advertise the nursery and products offered on the subject property. That if granted, the conditional use permit will not grant the Applicant special privileges that are denied by the City Code to other commercially used properties. 10. That if granted, the conditional use permit will not impair the enjoyment or market value of surrounding properties.
