TO:

MEMORANDUM

Mayor and Councilmembers

FROM: Dave Hartley, City Administrator

RE: Update to City Council Agenda of October 25, 1988

DATE: October 21, 1988

Since the preparation of the agenda for the City Council meeting of October 25,
1988, additional and useful information has become available as follows:

PERSONNEL COMMITTEE REPORT:

The Personnel Committee recommends to the City Council that the following rates
be approved for payment to the firm of Randall, Dehn, and Goodrich and City
Attorney William Goodrich:

Prosecution:
Civil Matters:
Meeting Attendance:
Non-City Business:

$60.00 per hour
$75.00 per hour
$100.00 per meeting
$100.00 per hour

The Personnel Committee further recommends that the rate charged to applicants
and other persons requesting legal services via the City Attorney shall be
billed at the rate of $80.00 per hour to cover the City's billing costs and the
fees paid to the City Attorney to be present at meetings.

The Personnel Committee also interviewed applicants for the position of
Community Development Director and recommends that the position be offered to
Mr. Mark Banwart at a starting rate of $28,000 per year and a starting date of
November 1, 1988. Mr. Banwart will be present at the City Council meeting if
Councilmembers have further questions. Enclosed is a copy of Mr. Banwart's
application and resume.

CHARTER AMENDMENT:

The City of Ramsey Charter Commission met on Thursday, October 20, 1988 and
reviewed the status report on the proposed amendment to the City Charter
including a chapter entitled "Police Department". After their review, the
Charter Commission suggested amendments to the proposed Charter amendment and
requests that the City Council unanimously adopt the revised proposed Charter
amendment. Reasons which were given were that the Charter amendment would not
be inconsistent with the City Charter and that by adopting the amendment the
City of Ramsey could forego the cost of a special election. Enclosed is a copy
of the proposed Charter amendment.

CONDITIONAL USE PERMIT REQUEST OF WASTE MANAGEMENT OF MINNESOTA, INC.:

Mr. Don Otter of Waste Management of Minnesota, Inc. contacted City
Administrator Dave Hartley via telephone and requested that Waste Management of
Minnesota, Inc.'s conditional use permit request be withdrawn from the City
Council agenda until some future date. The City Council may, at WMMI's
request, table this item. However, the Council should recognize that the
City's zoning regulations require that an action be taken by the City Council
within 30 days after receipt of the conditional use permit request from the
Planning and Zoning Commission (before November 25, 1988). Enclosed is a
letter zrom Mr. Terry Miller of WMMI.

DRH:pjc
