City Attorney Goodrich suggested the language state: Not to exceed queuing of four for more <br />than ten percent of the hours the establishment is open. <br /> <br />Councilmember Kurak noted if the cars back up a little bit in the morning when people are <br />going to work it would be for a limited amount of time. City Attorney Goodrich indicated the <br />ten percent concept is not well drafted at this point, and he would like the authority to improve <br />the language. Mr. McDonald suggegted a two-hour time frame be allowed, rather than 10 <br />percent of the hours, which is a little short. <br /> <br />Motion on the floor amended by Councilmember Cook, seconded by Councilmember Kurak, to <br />approve the request for Ramdance, LLC for a Conditional Use Permit for a drive-tlncu feature <br />on the Pond Building, based on the findings of fact, and adopt Resolution #04-12-388 declaring <br />terms of same, with the following additional conditions, and with authority for the City <br />Attorney and City Planner to improve the language: <br /> · For co flee shop type uses, which require minimal drive up use and will not include fast <br /> food restaurants. <br /> The traffic pattern for the use shall be designed to prohibit the queuing of vehicles to no <br /> more than four vehicles from the menu station and back, except the queuing of more <br /> than four vehicles shall be permitted during 20 percent of the establislnnent's operating <br /> hours. <br /> <br />Councihnember Kurak stated the intent of the Council is clear in regards to the queuing. <br /> <br />Motion carried. Voting Yes: Mayor Pro Tern Zimmerman, Councilmembers Cook, Kurak, <br />Elvig, and Pearson. Voting No: None. Absent: Mayor Gamec and Councilmember <br />Strommen. <br /> <br />Mayor Pro Tern Zimmerman requested this be presented to the Planning Commission for <br />review. <br /> <br />Case #10: <br /> <br />Request for Preliminary Site Plan Approval of the Pond Building in <br />Ramsey Town Center 3''a Addition; Case of Ramdanee, LLC <br /> <br />Community Development Director Frolik indicated Ramdance, LLC has submitted a <br />preliminary site plan for approval of the fourth and final building in Phase 1 of the Ramsey <br />Town Center 3''d Addition, Lot 1. The istmctures previously approved for the Phase 1 include <br />the Cobom's grocery store, the Comer retail building in the northeast corner of the site, and the <br />Gateway retail building in the northwest comer of the site. This fourth building backs up to the <br />pond adjacent to Armstrong Boulevard, and will be referenced as the Pond Building. The site <br />plan for thc Pond Building generally conforms to the Town Center Development Guidelines. <br />The west side of the building includes an outdoor dining area that overlooks the landscaped <br />pond. The selected architectural materials include brick, EIFS, split face CMU integrally <br />treated with color, and metal accents.
