Board Member introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #05-xx-~Xx <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF'A VARIANCE TO IMPERVIOUS <br />SURFACE RESTRICTIONS ESTABLISHED IN THE WILD AND SCENIC OVERLAY <br />DISTRICT AND DECLARING TERMS OF SAME <br /> <br /> WHEREAS, Fe[co Properties and Riverside Companies has properl~y apptied for a <br />variance to maximum impervious surt'ace restrictions established in the Wild and Scenic Overlay <br />District on the property legally described as fotlows: <br /> <br />Outlot A, River's Bend 3rd Addition, Anoka County, Minnesota <br /> <br />And <br /> <br />Outlot B, River's Bend 3rd Addition, Anoka'County, Minnesota <br /> <br />(the "Subject Property") <br /> <br /> WHEREAS, the Board of Adjustment met on January 6, 2005, conducted the public <br />hearing and adopted findings of fact relating to the request for a variance. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF tL4.MSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows <br /> <br />Based on Findings of Fact # j., a variance to the maximum impervious <br />surface restrictions established in the Wild and Scenic River Overlay District is hereby <br />granted, contingent upon certification t¥om the Commissioner of the Department of <br />Natural Resources. <br /> <br />That the Permittee shall not exceed impervious surface lot cover, which includes building <br />and pavement area, oI'more than 55% for the Subject Property and as reflected on the Site <br />Plan prepared by Hakanson Anderson dated and EM Branstrom Associates <br />.Architects Inc. dated <br /> <br />The property .owner shall obtain all necessary permits prior to commencing any <br />construction. No building permit for the structures shall be released by the City of <br />Ramsey without certification of the variance by the Department of Natural Resources in <br />accordance with procedures established in Section 9.23.06 (Scenic River District <br />Provisions) of the Ramsey City Code. <br /> <br />The prope~ty owner shall be responsible for all City costs incurred in administering and <br />enforcing this variance. <br /> <br /> <br />
