10. <br /> <br />1I. <br /> <br />12. <br /> <br />15. <br /> <br />17. <br /> <br />That the Applicant is requesting a variance from the-five foot maximum front yard setback in <br />order to construct the Ramsey Municipal Center as shown on the preliminary site plan dated <br />November 15, 2004. <br /> <br />That the Applicant has stated the variance requested, is the minimum variance needed to <br />alleviate the hardship. <br /> <br />That on December 2 and December 14, 2004, the Planning Commission and City Council <br />approved the preliminary, site plan of the Ramsey Municipal Center subject to conditions <br />contained in the City Staff Review Letter dated November 24, 2004 and the applicant <br />receiving a variance to the maximum setback standards in the TC-[ District. <br /> <br />That if granted, the variance will/will not permit a use that is prohibited in the TC-1 Town <br />Center Commercial District. <br /> <br />That if granted, the variance will/will not impair an adequate supply of light and air to <br />adjacent property,. <br /> <br />That if granted, the variance will/will not endanger the public safety. <br /> <br />That if granted, the variance will/will not unreasonably diminish property values in the <br />neighborhood. <br /> <br />That if granted, the variance will/will not violate the intent of the Comprehensive Plan. <br /> <br />That, if granted, the variance will/will not pant the Applicants any special privilege that <br />denied to other owners of land in the same district. <br /> <br />That undue hardship will/wili not result if the variance request is denied due to the existence <br />of special conditions and circumstances which are peculiar to the' land and which are/are not <br />applicable to other lands in the same district. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br /> , and upon vote being taken thereon, the fbllowing voted in favor thereof: <br /> <br />and the following voted against: <br /> <br />and the following abstained: <br /> <br />and the following were absent: <br /> <br />18 <br /> <br />RESOLUTION #05-01- <br /> Page 2 of 3 <br /> <br /> <br />
