CASE: <br /> <br />REQUEST FOR A VARIANCE TO IMPERVIOUS SURFACE RESTRICTIONS <br />ESTABLISHED IN THE WILD AND SCENIC RIVER OVERLAY DISTRICT; <br />CASE OF FELCO PROPERTIES AND RIVERSIDE COMPANIES <br /> By: Megan Wald, Associate Planner <br /> <br />Background: <br /> <br />Steve Feldman is proposing to develop the property that is located east of Highway #47, West of <br />Xkimo Street, and south of 143ra Avenue. The applicant submitted a sketch plan to plat one <br />buildable commercial lot and one outlot. In conjunction with the sketch plan the applicant <br />submitted a site plan proposing to construct a 12,000 square foot office complex. The Planning <br />'Commission reviewed the sketch plan and site plan at the December 2, 2004 meeting. The <br />Commission approved the sketch plan and recommended that the City Council approve the site <br />plan, contingent upon obtaining a variance. .. <br /> <br />The subject property is located within the Wild and Scenic River Overlay District and therefore <br />subject to a 30% impervious surface restriction, which includes building and pavement area. The <br />site plan exceeds impervious surface restrictions and therefore the applicant is' requesting a <br />variance. <br /> <br />The following items are enclosed: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Proposed Site Plan <br />Proposed findings of fact <br />Proposed variance <br /> <br />Notification: <br /> <br />As required by State Law, property owners within 350 feet of the subject property were notified <br />of the public hearing, in addition, the DNR was notified of the variance as required. <br /> <br />Observations: <br /> <br />The subject property is zoned B-i Business and is approximately 1.45 acres in size. The <br />'proposed site plan shows an impervious surface area that will not exceed 55%. If approved, the <br />variance will allow the construction of a 12,000 square foot office complex, sufficient parking <br />and maneuvering area, and a 10 toot pedestrian trail along the western boundary line. <br /> <br />The impervious surface restriction was established in an attempt to limit and monitor site runoff <br />to the Rum River. Run-off from the site is proposing to be discharged into an existing regional <br />stormwater system that adequately pre-treats runoff to the satisfaction of the Department of <br />Natural Resources (DNR).
