Assistant Community Development Director Trudgeon stated he believes the variance was in <br />what floor area ratio would be for all of Lot 1, 'Block 1. <br /> <br />Chairperson Nixt suggested that the floor area ratio be-rechecked since .there have been several <br />changes to building sizes and the car wash feature has been abandoned. <br /> <br />Commissioner Van Scoy asked if the foundation wall would be independent of the retaining <br />walls. <br /> <br />Mr. Voss indicated they are reviewing that, but they will probably be independent. He stated if <br />they are connected they will be lookinglat the design. He stated' the wall would be fixed and <br />would not move with the expansion. He asked if the Planning Commission would be willing to <br />grant approval for the site plan with the exception of the traffic flow issues. <br /> <br />Assistant Community Development Director Trudgeon suggested they could require that the final <br />site plan come back to the Planning Commission, which is not typical procedure, so the <br />preliminary site plan can move on to the City Council with the concerns and exceptions <br />discussed by the Planning Commission. <br /> <br />Commissioner Brauer agreed that was a viable solution, which would give the City Council to <br />bring up any other issues they may have. <br /> <br />Motion by Commissioner Brauer, seconded by Jeffrey to recommend that the City Council grant <br />approval of the preliminary site plan for the Pond Building in Ramsey Town Center 3rd Addition <br />contingent upon the following: <br /> <br />a) compliance with City Staff Review Letter dated November 23, 2004; <br />b) obtaining a variance to the .front yard setback requirements; <br />c) obtaining a Conditional Use Permit for the drive-up feature; <br />d) resolution of the Planning Commission concerns as outlined in the minutes; <br />e) Planning Commission being permitted to do a final site plan review. <br /> <br />Chairperson Nixt indicated he does not want to shirk their responsibility, and wants to make surb <br />they get another change to ensure this site plan is revised in an acceptable manner. <br /> <br />Commissioner Brauer stated he completely agrees. He indicated he would not want it to appear <br />the Planning Commission was just approving this and sending it through for the City Council, <br />however he feels this allows the case to move forward with fewer delays while ensuring the <br />Planning Commission will have another chance to review the plan. <br /> <br />Motion carried. Voting Yes: Commissioners Brauer, Jeffrey, and Shepherd. Voting No: <br />Chairperson Nixt and Commissioner Van Scoy.
