Mayor Gamec asked if Mr. Bray agrees with the changes to the document according to the <br />Council's direction. <br /> <br />Mr. Bray responded in the affirmative. <br /> <br />Mayor Gamec asked if City Attorney Goodrich agrees with the changes to the document. <br />City Attorney Goodrich responded in the affirmative. <br /> <br />Mayor Gamec asked if Mr. Nedegaard agrees With the changes to the document. <br /> <br />Mr. Nedegaard responded in the affirmative. <br /> <br />Councilmember Strommen questioned if the .term activel, v working on in Paragraph No. 3 needs <br />to be better defined. <br /> <br />City Attorney Goodrich replied the whole agreement will be bette~: defined. <br /> <br />Mr. Bray explained Paragraph No. 3 provides 'for a separate option agreement that will be <br />executed at the same time the amendment to the Master Development Agreement is executed. <br /> <br />Councilmember Kurak asked how the time frame for closings will be affected if this amendment. <br />is approved tonight. <br /> <br />City Attorney Goodrich replied his belief is that this would give Shingobee Development more <br />comfort to go forward, however, he is not sure that will happen. <br /> <br />Mr. Nedegaard stated Shingobee Development is not present at this time, and he needs to discuss <br />the agreement with them, but he believes what has been discussed tonight makes a lot of sense, <br />and will hopefully work out. <br /> <br />Motion 'by Councilmember Cook, seconded by Councilmember Kurak, tO approve the General <br />Business Terms and Conditions for an amendment to the DeVelopment Agreement with Ramsey <br />Town Center LLC as presented this evening, and as shown in the Council packet dated <br />November 4, 2004, and as amended in paragraphs 2, 6 and 7. <br /> <br />Further discussion: Councilmember Elvig noted the fiscal impact studies show this will not <br />affect the general taxpayer. Councilmember Kurak stated any assessments they have discussed <br />tonight in regard to this development remain within this development. Councilmember Cook <br />commented another benefit is that this moves the assessments earlier, which allows them to get <br />some of the infrastructure moving along, which is a benefit to the City. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Kurak, Elvig, Pearson, and <br />Strommen. Voting No: None.
