Councilmember Strommen introduced the following resolution and moved for its adoption: RESOLUTION #04-10-311 RESOLUTION APPROVING 1s~r PARTIAL PAYMENT TO BAUERLY BROS. INC FOR 2004 PAVEMENT MAINTENANCE PROGRAM - DIVISION B WHEREAS, on May 11, 2004, the Ramsey City Council authorized plans and specifications and advertisement for bids on 2004 Street Maintenance Program - Division B, and WHEREAS, on June 8, 2004, the Ramsey City Council adopted Resolution #04-06-147 awarding the bid for 2004 Pavement Maintenance Program - Division B to Bauerly Brothers in the amount of $54,179.03, and WHEREAS, City Engineer, Steve Jankowski has inspected the completed work and recommends partial payment to Bauerly Brothers, Inc. in the amount of $54,179.03. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the City Council hereby authorizes partial payment to Bauerly Brothers, Inc. for Improvement Project 2004 Street Maintenance Program - Division B in the amount of $54,179.03. 2) That the City Council hereby accepts the project and authorizes the Mayor or City Administrator to sign the release form for this payment. 3) That the total amount of this payment is not included in resolutions approving payment of bills for the date of October 12, 2004. 4) That the City of Ramsey Finance Department will be provided a signed copy of this resolution. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Elvig, and upon vote being taken thereon, the following voted in favor thereof: Mayor Gamec Councilmember Strommen Councilmember Elvig Councilmember Cook Councilmember Kurak Councilmember Pearson Councilmember Zimmerman and the following voted against the same: RESOLUTION #04-10-311 Page 1 of 2
