16. <br /> <br />17. <br /> <br />18. <br /> <br />19. <br />20. <br /> <br />That if granted, the variance will not unreasonably increase the congestion in the <br />public street. <br />That if granted, the variance will not increase the danger of fire or endanger the <br />public safety. <br />That if granted, the variance will not unreasonably diminish property values in the <br />neighborhood. <br />That if granted, the variance will not violate the intent of the Comprehensive Plan. <br />That, if granted, the variance will grant the Applicants any special privileges that <br />is denied to other owners of land in the same district. <br /> <br />City Attorney Goodrich stated findings 12, 13 and 20 were key in focusing in on this. <br /> <br />Councilmember Zimmerman stated that finding 19 was what was used in the Planning and <br />Zoning Commission. <br /> <br />Community Development Director Frolik stated she was at the meeting and they did not review <br />these one by one. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Anderson, to adopt <br />Resolution #02-06157 adopting Findings of Fact #0621 relating to Geno and Laurie Ronallo's <br />request for a variance. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Anderson, and <br />Zimmerman. Voting No: Councilmember Kurak. <br /> <br />Councilmember Hendriksen stated that he would like City Attorney Goodrich to read the State <br />Statute section regarding this. <br /> <br />City Attorney Goodrich stated that it was true. <br /> <br />Motion by Mayor Gamec, seconded by Councilmember Kurak, to approve Geno and Laurie <br />Ronallo's request for a variance to the side yard setback requirements and adopt the resolution <br />declaring terms of the variance at a 30-foot setback. <br /> <br />Motion denied. Voting Yes: Mayor Gamec and Councilmember Kurak. <br />Councilmember Anderson, Hendriksen, and Zimmerman. <br /> <br />Voting No: <br /> <br />Motion by Councilmember Zimmerman, seconded by Councilmember Anderson, to adopt <br />Resolution #02-06-158A denying Geno and Laurie Ronallo's request for a variance to the side <br />yard setback requirements, based on the findings of fact. <br /> <br />Motion carried: Voting Yes: Councilmembers Zimmerman, Anderson, and Hendriksen.
