Councilmember Zimmerman asked if State law allows cities to have an administrative process <br />and levy fines. <br /> <br />City Attorney Goodrich stated the City can levy a civil fine similar to the collection of other <br />judgments or assessments. He explained there would not be a District Court Judge but an <br />Administrative Hearing Examiner who would be hired from the Office of Administrative <br />Hearings or someone locally could be hired. <br /> <br />Consensus of the City Council was to direct staff to research the establishment of an <br />administrative process. <br /> <br />Councilmember Hendriksen stated he would like to address an administrative issue under Mayor <br />and Council prior to adjournment. <br /> <br />3) Conditional Rezoning (6/25/03) <br /> <br />City Administrator Norman reviewed a draft ordinance and noted the added language from the <br />City Attorney. <br /> <br />Principal Planner Trudgeon noted a correction needed to the section numbers. He explained that <br />the City Attorney has not conducted a final review so there may be some revisions. Principal <br />Planner Trudgeon reviewed the proposed ordinance and added Subsection 9.03.13 to address <br />conditional Comprehensive Plan amendments. He noted that the Metropolitan Council also <br />needs to approve any Comprehensive Plan amendment to change the land use designation. <br /> <br />City Attorney Goodrich stated a public hearing will be needed. <br /> <br />Councilmember Hendriksen stated it was mentioned by City Attorney Goodrich at the last <br />meeting that he had no familiarity with the issue around redacting an amendment to the <br />Comprehensive Plan. <br /> <br />City Attorney Goodrich stated that there is a precedent for a conditional rezoning and he found <br />cases to that effect but found no cases for a similar process with the Comprehensive Plan. If the <br />City Council wants to proceed, then he would recommend it be reviewed by the Metropolitan <br />Council who will be the final deciding factor on whether it could be changed back. <br /> <br />Councilmember Hendriksen stated he would like their reaction on this since it is his belief that <br />the Met Council supports more density so he thinks they will not allow Ramsey to lower the <br />density. Also, costs will be incurred as a result of this process and he asked if those incremental <br />costs can be captured through a deposit or funding. <br /> <br />City Attorney Goodrich stated it could be through an escrow or application fee. <br /> <br />City Council Work Session/July 23, 2002 <br /> Page 10 of 11 <br /> <br /> <br />
