creates much of the problem themselves since there are no issues in Ramsey that have been <br />litigated through the courts, where the City has hired attorneys to pursue. Now, because the <br />individual puts up a little resistance, the City decides to ignore it. Councilmember Hendriksen <br />stated that once that is done, the word gets around. He stated he can name several places where <br />the City has told residents they need to be in compliance, the City has known about it for a long <br />time, it's been brought up numerous times, but nothing has been done about it. He asked why <br />the City needs something else. <br /> <br />Mayor Gamec stated the problem is that the court system puts it off and doesn't want to deal <br />with it either. <br /> <br />Councilmember Hendriksen stated he can name properties that have been out of compliance for <br />ten years or longer and it's still there, He asked why something has not been done. <br /> <br />Mayor Gamec stated that once it is put on the court docket, it is always being put off. He <br />referred to one case that was put off for two years. Mayor Gamec stated the City needs to look at <br />the big picture. <br /> <br />Councilmember Hendriksen named an incidence where the City took a violation to court and <br />another that has never been in compliance with their conditional use permit but has not been <br />taken to court. He asked why there is selective enforcement. <br /> <br />Mayor Gamec stated that based on Councilmember Hendriksen's comments, it appears the City <br />should go after the violations and take care of them. He agreed that the City can't just look at <br />some. <br /> <br />Councilmember Hendriksen stated he does not think the City should take a position with various <br />individuals and say they need to clean something up or set standards and then when it is ignored, <br />walk away from it and let it go on. <br /> <br />Mayor Gamec agreed and stated the City should prosecute them. <br /> <br />Councihnember Kurak stated she thinks the problem is with the violators who do not comply. <br /> <br />Councilmember Hendriksen stated an example of the person with the bobcats that did a nice <br />landscaped sign that did not get bigger but it was framed nicer, set back farther from the road, <br />and landscaped, and for some reason that guy ended up in court. On the other hand, there is a <br />property with several dozen junk inoperable cars where staff has been visited several times. <br /> <br />Community Development Director Frolik stated they do not have a conditional use permit and <br />she has been there half a dozen times at least, documented the violation, and sent it for <br />prosecution twice but it has not yet gotten on the docket. <br /> <br />City Council Work Session/July 23, 2002 <br /> Page 7 of 11 <br /> <br /> <br />
