City Attorney Goodrich suggested the language state: Not to exceed queuing of four for more than ten percent of the hours the establishment is open. Councihnember Kurak noted if the cats back up a little bit in the morning when people are going to work it would be fOr a limited amount of time. City Attorney Goodrich indicated the ten percent concept is not well drained at this point, and he would like the authority to improve the language. Mr. McDonald sUggeSted a two-hour time frame be allowed, rather than 10 percent of the hours, which is a little shOrt. Motion on the floor amended by Councilmember Cook, seconded by Councilmember Kurak, to approve the request for Ramdance, LLC for a Conditional Use Permit for a drive-thru feature on the Pond Building, based on the find!ngs of fact, and adopt Resolution #04-12-388 declaring terms of same, witt~ the following additional conditions, and with authority for the City Attorney and City Planner to improve the language: · For coffee shop type uses, Which require minimal drive up use and will not include fast tbod restaurants. · The traffic pattern for the use shall be designed to prohibit the queuing of vehicles to no more than four vehicles from the. menu station and back, except the queuing of more than four vehicles shall be permitted during 20 percent of the establishment's operating hours. Councihnember Kurak stated the intent of the Council is clear in regards to the queuing. Motion carried. Voting Yes: Mayor Pro Tem Zimmerman, Councilmembers Cook, Kurak, Elvig, and Pearson. Voting No: None. Absent: Mayor Gamec and Councilmember Strommen. Mayor Pro Tern Zimmennan requested this be presented to the Planning Commission for review. Case #1 O: Request for Preliminary Site Plan Approval of the Pond Building in Ramsey Town Center 3,'a Addition; Case of Ramdance, LLC Community Development Director Frolik indicated Ramdance, LLC has submitted a preliminary site plan for approval of the fourth and final building in Phase 1 of the Ramsey Town (;entel' 3..0 Addition, Lot 1. The structures previously approved for the Phase 1 include the Cobom's grocery store, the Comer retail building in the northeast comer of the site, and the Gateway retail building in the northwest comer of the site. This fourth building backs up to the pond adjacent to Armstrong Boulevard, and will be referenced as the Pond Building. The site plan for the Pond Building generally conforms to the Town Center Development Guidelines. The west side of the building includes an outdoor dining area that overlooks the landscaped pond. The selected architectural materials include brick, EIFS, split face CMU integrally treated with color, and metal accents.
