Assistant Community Development Director Trudgeon explained the combination of
townbomes and single-family lots in the northern portion of the plat will need to be processed
as a ?fanned Unit Development. The proposed development will also need to go tlu'ough site
plan review, most likely at the preliminary plat stage. The revised sketch plan is proposing to
construct a combination of pubhc and private streets throughout the development, similar to the
strects that were approved with the first two phases of Town Center Gardens. The revised
sketch plan shows 148th Avenue being brought to the western boundary of the plat. This is in
compliance with City Code, which requires streets to be brought to the edge of the plat to
facilitate development on adjacent parcels, should it occur. He explained a temporary cul-de-
sac will need to be provided on 147th Lane NVv'; this street also exceeds the maXimum cul-de-
sac length as outlined in City Code. A variance will be required for this length of cul-de-sac.
Staff finds this plan generally acceptable and recommends the plan move ahead into the
platting process.

Councihnember Cook asked if this could be accomplished under a PUD, rather than an
amendment to the Comprehensive Plan:and zoning change. He stated he would hate to see
commercial property coming in there down the line because it is zoned multi-use.

Assistant Community Development DireCtor Trudgeon replied he is not sure if the codes allow
for increasing density through just a :simple PUD process, which might undermine the
Comprehensive Plan process. The second thing would be the precedent that would be set. The
north area of this subdivision will be a PUD because of the single-family homes and
townhomes, and the PUD is necessary to increase the density. If the Council would like to
procecd that way he would be happy to see if it is allowed and confer with the City Attorney.

Councihnember Elvig concurred with Councilmember Cook. He expressed concern that mixed
usc opens up a can of worms in the long term with the possibility of commercial use.

Assistant Community Development Trudgeon advised the zoning is TC-4a, which is primarily
residential.

Councihnember Kurak inquired about snow storage.

?hil Domer, Vice-President of Brightkeys, Inc., replied there are designated snow removal
arcas.

Assistant Community Development Director Trudgeon indicated the City will take care of
snow in the public streets.

Assistant Public Works Director Olson advised the snow from the public street will be moved
within the right-of-way. He noted this ~s part of the Phase 2 roadways in Town Center that
have had approval of feasibility study preparation. The roadways directly to the west of this
long cul-de-sac will be moving forward and will provide the second alternative access to this
subdivision. The alignments of those right-of-ways will be considered when the preliminary
plat comes forward with this subdivision.!

City Council/December 14, 2004
