Councihnember Anderson noted the location of several very nice fences and suggested that they <br />be viewed. <br /> <br />City Engineer Olson stated that staff will continue to talk with the property owner at 15252 Zuni <br />Street NW and show him fence samples from Menards to see if he would like any of them. He <br />stated it appears the property owner may be requesting a heavier construction that would cost <br />lllOl'e. <br /> <br />Councihnember Zimmerman stated it is unfortunate that house is a lot closer than those are from <br />Highway #47. He noted that this house is very close to where people walk and sometimes they <br />walk on the boulevard. He stated he would support staff continuing to work with the property <br />owner. <br /> <br />City Engineer Olson stated he will continue to work with the property owner and the discussion <br />was to get this resolved without going through condemnation. <br /> <br />Mayor Gamec agreed with the need for the process to be continued. <br /> <br />Motion by Mayor Gamec, seconded by Councilmember Kurak, to adopt Resolution 02-07~178 <br />authorizing eminent domain to obtain the easement necessary for construction of the trail along <br />Alpine Drive. <br /> <br />Further discussion: Councilmember Hendriksen asked if staff feels the property owner is still <br />negotiating. Public Works Director Kapler stated he thinks they are 90% there and only have to <br />work out the details on the type of fence. However, from a staff perspective, it is recommended <br />to continue just in case it is not resolved. Public Works Director Kapler stated he has not had the <br />opportunity to talk with this individual. City Engineer Olson stated the property owner is <br />difficult to get hold of. Councilmember Hendriksen stated he has seen Public Works Director <br />Kapler do some remarkable things on County Road #116 where others had failed. He stated he <br />understands the need to proceed as a fail/safe. Public Works Director Kapler commended City <br />Engineer Olson for his work in negotiating this and stated his intent to continue that process. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, Anderson, and <br />Hendriksen. Voting No: Councilmember Zimmerman. <br /> <br />Case #11: Report from Personnel Committee <br /> <br />1) <br /> <br />Receive Information About Resignation of Planning Commission Member and <br />Authorize Staff to Recruit to Fill the Vacancy <br /> <br />Councilmember Anderson presented the recommendation of the Personnel Committee to <br />adopt Resolution #02-07-179 accepting Kathleen Sweet's resignation, with regret, from <br />the Ramsey Planning Commission effective immediately and authorize staff to begin the <br />process to fill the vacancy on the Ramsey Planning Commission. <br /> <br />City Council/July 23, 2002 <br />Page 26 of 30 <br /> <br /> <br />
