Further discussion: Councilmember Anderson asked if the opt-out option would also be dealt <br />with. City Attorney Goodrich stated it will be, as well as, a ten-year lease term. He stated he <br />will also contact the State about what they expect. Councilmember Anderson stated she thinks <br />the State would not consider a one-year opt out clause. Councilmember Hendriksen asked if it is <br />the consensus that the final lease will not allow the property owner to opt out at a point in time <br />shorter than the full term of the lease. City Attorney Goodrich stated it is his understanding that <br />the majority of the Council would not want to enter into this agreement if the landlord could opt <br />out after a period of one year. He stated they will negotiate that with the property owner. <br />Councilmember Hendriksen asked if City Attorney Goodrich will clarify the State expectations <br />in writing, what an equivalent parking lot means and for how long. Councilmember Zimmerman <br />stated if the property was being bought and made a Park and Ride, he could go for it but it does <br />not appear to be for any length of time. Councilmember Hendriksen noted this is not final <br />approval of the lease but to direct the City Attorney to conduct further negotiations. <br /> <br />Amendment carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, Anderson, and <br />Hendriksen. Voting No: Councilmember Zimmerman. <br /> <br />City Attorney Goodrich stated he will contact the State to determine the term of the grant <br />contract and equivalent replacement. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, Anderson, and <br />Hendriksen. Voting No: CouncilmemberZimmerman. <br /> <br />Case #1: Authorization for an Agreement with MnDOT for the Park and Ride Facility <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Zimmerman, to table <br />consideration of the City entering into an agreement with the State of Minnesota for design, <br />construction, and operation of a Northstar Commuter Coach demonstration project Park and Ride <br />facility. <br /> <br />Further discussion: Councilmember Hendriksen stated there is a consensus for City Attorney <br />Goodrich to do further negotiation so the motion is to table subject for that more information. <br />City Engineer Olson stated that tabling the agreement would not cause a problem with designing <br />and site survey as long as Case #2 is acted on so Hakanson Anderson can start design work. He <br />noted the grant agreement ties the State into the $416,000 to utilize for the Hakanson Anderson <br />work. Councilmelnber Hendriksen asked how much work would be done between now and <br />August 13, 2002. City Engineer Olson stated that substantial work would be completed and a <br />survey crew has been arranged to begin tomorrow. Councilmember Anderson asked if there is <br />consensus that this will be worked out so Hakanson Anderson can being work. Councilmember <br />Hendriksen asked how many dollars worth of "go ahead" they would be given. City Engineer <br />Olson reviewed the work that could be completed and estimated a cost of $35,000. <br />Councilmember Hendriksen stated the Council would be risking $35,000 if the grant agreement <br />is more onerous than envisioned or if they can't come to an agreement with the lease. <br /> <br />City Council/August 5, 2002 <br /> Page 10 ofll <br /> <br /> <br />
