revenue collected for the temporary site for people using the coach plan. Mr. Feges noted there <br />is a tight timeframe to participate in this demonstration project and this is a premium site but <br />there are benefits to support multimodal transportation and provide residents with access to it. <br />Councilmember Hendriksen stated he understands the benefit to Mr. Feges and the citizens and <br />agrees the timing is bad but the problem is that the Council is being asked to make a $600,000 <br />commitment to replace that facility in the future if it becomes necessary. He asked Mr. Feges if <br />he would be willing to enter into a contract with Ramsey to provide that $600,000. Mr. Feges <br />stated he would provide space within the master plan to replace those temporary parking spaces <br />to accommodate an alternate site in the master plan. He stated that is already included in the <br />preliminary stages. Mr. Feges stated the temporary site could also be changed to a permanent <br />site if they are not successful in coming up with a plan for the Town Center. He stated this site <br />was studied prior to introducing the Town Center concept. Councilmember Hendriksen stated <br />this site was picked since it would provide the highest score on the TAZ. He restated that the <br />Council is being asked to sign a document to commit the City to $600,000 but there is no "if" in <br />this document. Mr. Feges stated they would be willing to sign a statement to say they will <br />replicate. Mayor Gamec stated he does not know if a future Council will want Mr. Feges to mn <br />the station and they will probably look at the options available at that time. City Administrator <br />Norman stated the number he is hearing the City is on the "hook" for ($600,000) is simply made <br />up and noted that the Town Center plan could tie in the parking, so that is a false argument. <br />Mayor Gamec agreed that is the worst scenario and he likes to look at positives. He noted the <br />Task Force is looking at how to provide transportation in that facility and have costs absorbed by <br />the Town Center or other grants. He stated people have been asking for transportation and this <br />would get that going and help citizens of the whole area including Bums Township. He stated he <br />can paint a bad scenario but the future Council will negotiate this out and he prefers to look at the <br />opportunities and future of the Town Center. Councilmember Hendriksen stated Mr. Norman <br />stated this was a made up scenario and he would like to defer to Mr. Goodrich to interpret Page <br />1, II., E., of the grant contract. Councilmember Kurak stated the motion on the floor is on Case <br />#3, not Case #1, which is the grant contract. City Attorney Goodrich read the statement referred <br />to by Councilmember Hendriksen and explained that the City could find 168 spaces someplace <br />that are equivalent and agreeable to the State. City Engineer Olson stated it could be built into <br />the design of the Town Center. City Attorney Goodrich stated the key is that it must be <br />agreeable to the State. Councilmember Anderson stated the term of the contract expires <br />December 31, 2003, and commented on the need to meld it with Section II., E. She asked how <br />long the City is to do that. City Attorney Goodrich stated there is not a finite term and he would <br />request clarification from the State on that question. Councilmember Anderson stated that <br />provision needs to meld with the opt-out clause. City Attorney Goodrich noted the agreement <br />also talks about "recipient" but the City is referred to as "grantee" so the grant contract needs <br />some refinement. Councilmember Hendriksen stated the City could provide the 168 spaces in <br />some other way but in the absence of providing them in some other way, wouldn't the City be <br />responsible to provide them at the City's cost. City Attorney Goodrich stated that is correct and <br />it would have to be equivalent and agreeable to the State. He noted that this does not indicate <br />how long the City is responsible to provide that. Councilmember Hendriksen stated it appears <br />the agreement has the provision to opt out on the part of the property owner in one year and the <br />City has a legal requirement to replace it should that occur.
