two Park and Ride facilities in both Elk River and Coon Rapids Riverdale. MnDOT has recently <br />agreed to grant funds for the design, construction, and operation of a similar Park and Ride <br />facility in the City of Ramsey. The site of the proposed Park and Ride facility would be located <br />on the property currently owned by BMA Associates to the west of Ramsey Boulevard and north <br />of Trunk Highway #10. In order to initiate the design, construction, and operation of the Park <br />and Ride facility, the City will need to authorize a contractual relationship with the State of <br />Minnesota. Attached to the case is agreements stating the State will provide financing for <br />design, construction and operation of the Park and Ride facility in exchange for the City's ability <br />to provide land for the facility. Also attached to the case is a resolution authorizing the City to <br />enter into the agreement with the State of Minnesota to receive the Federal Transit <br />Administration funds for the Park and Ride facility. As instructed during the August 5 special <br />meeting of the City Council, the City Attorney has been in discussions with MnDOT <br />representatives regarding clarification of terms of the grant to operate the Park and Ride facility. <br />The City Attorney will report his discussions during the Council meeting. Staff recommended <br />that the City enter into the agreement with the State of Minnesota for design, construction, and <br />operation of a NORTHSTAR COMMUTER COACH demonstration project Park and Ride <br />facility. <br /> <br />Councilmember Hendriksen inquired as to whom had prepared the lease agreement. <br /> <br />City Attorney Goodrich replied that he had. <br /> <br />Councilmember Hendriksen replied that he was disappointed with the contract because the dates <br />in the lease agreement did not match up to what is included in the grant agreement. <br /> <br />City Attorney Goodrich explained that the State had been discussing the term of the grant <br />contract and had not come to a final conclusion until today. He talked to the landowner's <br />attorney and they have indicated that they would agree to being obligated to give an equivalent <br />park and ride facility for the first 10-year term of the lease. The agreements in their final form, <br />will be in agreement with each other. The property owner will not be allowed to ask the City to <br />move the park and ride facility unless they have an equivalent location for the site and it is <br />agreeable by the state. He noted that the first right of refusal was deleted from the lease. Mr. <br />Goodrich stated that it would seem that the City's liability is limited because if they are asked to <br />move the facility it can only be if the lessor provides a replacement facility during the term of the <br />lease. <br /> <br />Councilmember Anderson stated that her largest concern is making sure the three documents <br />agree with one another. <br /> <br />City Attorney Goodrich replied that the obligation is for 10 years and he will make sure the dates <br />are the same on all documents. <br /> <br />Councilmember Anderson inquired as to what happens if the State discontinues the service. <br /> <br />City Council/August 13, 2002 <br /> Page 11 of 25 <br /> <br /> <br />
