Case#4: Receive Bids and Award Contracts for Improvement Project #02-34, <br /> Construction of Ramsey Park and Ride Facility <br /> <br />Principal City Engineer Olson stated that Improvement Project #02-34 consists of the <br />construction of a 175 lot multimodal facility. Authorization to advertise for bids was ordered on <br />August 19, 2002, and bids were scheduled to be received Friday, September 20, 2001. The City <br />did receive two bids, but the bids came in significantly higher than the engineers estimate. Staff <br />recommended that the Council deny the bids for that reason. Mr. Olson noted that he did talk to <br />the State of Minnesota and they did not feel that rejecting the bids would infringe on the <br />opportunity. They concurred with re-bidding the project. <br /> <br />Motion by Councilmember Anderson, seconded by Councilmember Kurak, to reject all bids. <br /> <br />Further discussion: Councilmember Kurak inquired as to where it left the City in regards to the <br />lease agreement. Principal City Engineer Olson replied that they did not yet have a signed lease <br />agreement. City Attorney Goodrich stated that the lease could be concluded, but based on the <br />bid information, they will hold off on concluding the lease until they get a contract. <br />Councilmember Kurak inquired if the City Attorney felt there was any threat of losing the site. <br />City Attorney Goodrich replied that that is always a possibility. Councilmember Kurak inquired <br />if that seemed to be an issue. City Administrator Norman replied no. Councilmember <br />Hendriksen inquired if all the problematic issues with the lease agreement were addressed. City <br />Attorney Goodrich replied that there were some modifications, but he will bring that back before <br />the Council before authorizing the agreement. Councilmember Hendriksen inquired if the <br />Council could review the draft agreement. City Attorney Goodrich replied yes. Councilmember <br />Kurak requested that the City Attorney clarify that the park and ride is not going to be located on <br />any property that she owns or her husband owns. City Attorney Goodrich replied that he has <br />been in negotiations for a lease agreement with BMA properties who live in Eden Prairie. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Anderson, Kurak, Hendriksen, <br />and Zimmennan. Voting No: None. <br /> <br />Mayor Gamec noted that there have been rumors that C.R. #116 will be a four-lane road with a <br />center island all the way down, but there has been no decisions made. <br /> <br /> / <br />Case #5: Request for a Conditmnal Use Permit to Expand a Lawful Non-Conforming <br /> Ready-Mix pla~'fo Include a Second Silo: Case of Marshall Concrete <br /> <br />Community Development Director Frolik stated that Marshall Concrete is a lawful, <br />nonconforming concrete ready-mix plant located at 14141 Unity Street N.W. The company has <br />determined that their operation is in need of a second product silo. According to City Code, any <br />enlargement or expansion of a lawful nonconforming use must be done so in accordance with <br />City Code. Therefore, Marshall Concrete has applied for a conditional use permit for the <br />addition of the second silo.
