CC Regular Session 4. 8. <br />Meeting Date: 02/12/2018 <br />By: Bruce Westby, Engineering/Public <br />Works <br />Information <br />Title <br />Adopt Resolution #18-028 Approving MnDOT Delegated Contracting Process Agreement #1029992 <br />Purpose/Background: <br />Purpose: <br />The purpose of this case is to adopt Resolution #18-028 approving MnDOT Delegated Contracting Process <br />Agreement #1029992. <br />Background: <br />Pursuant to Minnesota Statute Section 161.36, the Commissioner of Transportation must be appointed an agent of <br />the City of Ramsey to accept Federal Aid funds that are awarded to the City of Ramsey for eligible transportation <br />related projects. The City cannot directly accept awarded Federal Aid funds for such projects. All Federal Aid funds <br />designated for use by the City must be processed through the Minnesota Department of Transportation (MnDOT). <br />Attached to this case is a copy of the City of Ramsey's current Delegated Contracting Process Agreement #99948 <br />executed in 2011. Also attached is a copy of proposed Delegated Contracting Process Agreement #1029992, which <br />following Council approval will replace the existing agreement. A copy of the accompanying cover letter from <br />MnDOT dated December 1, 2017 is also attached. As is noted in the cover letter, the language in section 18.4 is <br />required by federal law and must be included in all federally funded project agreements as of October 1, 2010. <br />City Staff reviewed proposed Delegated Contracting Process Agreement #1029992 and supports executing the <br />agreement as attached which will allow the City to receive awarded Federal Aid funds in the future. <br />On January 16, 2018, the Public Works Committee reviewed proposed Delegated Contracting Process Agreement <br />#1029992 and recommended City Council approval, contingent on review and approval by the City Attorney. <br />The City Attorney has since reviewed proposed Delegated Contracting Process Agreement #1029992 and supports <br />executing the agreement as drafted and attached. <br />Notification: <br />Notifications are not required for this case. <br />Observations/Alternatives: <br />Observations: <br />Upon Council approval, a certified copy of Resolution #18-028 will be provided to MnDOT with each of the two <br />(2) original agreements as requested. MnDOT will then provide an executed copy of DCP Agreement #1029992 to <br />the City for our records. <br />Alternatives: <br />Alternative #1 — Motion to adopt Resolution #18-028 approving MnDOT Delegated Contracting Process Agreement <br />#1029992. <br />Funding Source: <br />
