Any employee who believes that another City employee or elected official has eneaeed in <br />behavior prohibited by this policy is encouraeed to address the situation as described in <br />paragraphs (a). (b). and (c) below. However. if the alleged conduct involves violent <br />behavior. discriminatory behavior. or harassment prohibited by City policy. the employee is <br />responsible for reportine the situation to the appropriate supervisor in accordance with the <br />City's anti -harassment policy and paraeraph (c) of this policy.: <br />a) If possible. politely but firmly tell the person who is behaving inappropriately that you <br />are uncomfortable with or offended by the behavior and ask them to stop. <br />b) Write a memorandum for personal reference that describes the inappropriate behavior, <br />the date the inappropriate behavior occurred, how it made you feel, what you did, how the <br />offendine party responded. and the names and titles of any witnesses. <br />c) Report the conduct to your supervisor or department head or the employee's supervisor - - -f Formatted: Indent: Left: 0.5" <br />or department head. If the individual alleeedly eneaeine in behavior is an elected official, <br />report the conduct to the Citv's Human Resources Manaeer. City Administrator. the Mayor. <br />or a member of the City Council, as appropriat . <br />d) The complainine party should be prepared to provide the followine information: <br />1. The complainant's name. department an I position title. <br />2. The name. department. and position title of the offendine party. if known. <br />3. The specific facts of the alleeed inappropriate behavior, how lone it has <br />alleeedly none on, and any alleeed employment action (demotion, failure to <br />promote, dismissal, refusal to hire, transfer, etc.) that was supposedly taken <br />aeainst the employee who is filine the complaint. <br />4. Names of witnesses. if any. to the alleeed harassment. <br />5. Whether the complainant has previously reported the alleeed misconduct and, if <br />so, to whom. <br />5) Investieation of Complaints of Inannrom-iate Conduct <br />All supervisors and Department Heads receivine complaints of behavior prohibited by this <br />policy shall report them to the Hum. n Resources Manaeer. If the complaint involves <br />alleeed conduct by the Human Resources Manaeer, the supervisor or Department Head <br />shall instead report the complaint to the City Administrator. <br />The Human Resources Manaeer. the City Administrator. or a designee of the City <br />Administrator, shall investieate complaints of inappropriate workplace conduct prohibited <br />by this policy. <br />6) Consequences of Eneaeine in Inappropriate Workplace Conduct <br />Employees who are found to have eneaeed in conduct prohibited by this policy or to have <br />intentionally filed a false claim of such conduct may be subiect to disciplinary action. up to <br />and includine immediate termination, subiect to the provisions of the Personnel Policy, <br />applicable policies of the Police and Fire Departments, applicable collective bareainine <br />aereements or other contracts, and applicable law. <br />39IPage <br />
