CC Regular Session <br />Meeting Date: 02/27/2018 <br />By: Chris Anderson, Community <br />Development <br />Information <br />4.3. <br />Title <br />Adopt Resolution 418-046 Approving a Sidewalk Agreement and Density Transition Easement Related to Estates <br />of Silver Oaks 2nd Addition (Project 417-119); Case of Royal Oaks Realty <br />Purpose/Background: <br />The purpose of this case is to approve a Sidewalk Agreement and Density Transitioning Easement related to a <br />recently approved plat known as Estates of Silver Oaks 2nd Addition (the "Plat"). The Plat created eight (8) new <br />single family residential lots along Lithium Street, just north of 162nd Lane (the "Subject Property"). <br />Notification: <br />Notification is not required. <br />Observations/Alternatives: <br />Due to existing topography, the new sidewalk will terminate at the bulb of the cul-de-sac on Lithium Street rather <br />than extending north to the Plat boundary. The attached Sidewalk Agreement is intended to simply memorialize <br />that should Lithium Street ever be extended in the future, the sidewalk would also be extended in front of Lot 3, <br />Block 1 of the Plat. It does not obligate a future owner of Lot 3, Block 1 to contribute anything to the potential <br />future improvement. <br />The eastern boundary of the Plat abuts property zoned R-1 Residential (Rural Developing) and thus, density <br />transitioning was required along Lots 1-3, Block 1. A Density Transition Easement has been drafted that will help <br />the City with enforcement of the easement restrictions, should that be necessary in the future. <br />Funding Source: <br />All costs associated with this request are the Applicant's responsibility. <br />Recommendation: <br />Both the Sidewalk Agreement and Density Transition Easement are under review by the City Attorney.
