That the home developed on the adjacent property to the south (14650 Bowers Drive) was <br />constructed in 1986 and is approximately 160 feet from the Ordinary High Water Mark of the <br />Mississippi River. <br /> <br />10. That the applicant is proposing to maintain the existing vegetative screening that is presently <br /> located on the property in the bluff protection area. <br /> <br />11. That if granted, the variance will not adversely degrade the ability to view the river. <br /> <br />12. That if granted, the variance will not allow any use that is neither a permitted or a conditional <br /> use in the land use district in which the Subject Property is located. <br /> <br />13. That there are exceptional circumstances unique to the Subject Property which were not <br /> created by the Applicant; namely, the establishment of setbacks on the adjacent parcels. <br /> <br />14. That the strict enforcement of Section 9.21.07 of the Ramsey City Code will result in <br /> unnecessary hardship to the Applicant. <br /> <br />15. That if granted, the variance is not contrary to the purpose and intent of Section 9.21.07 of <br /> the Ramsey City Code. <br /> <br />16. That if granted, the variance will not alter the essential character of the area. <br /> <br />17. That if granted, the variance will not adversely impact the degree of public health, safety and <br /> general welfare provided for in the Ramsey City Code <br /> <br />18. That if granted, the variance will not unreasonably increase the congestion in the public <br /> street. <br /> <br />19. That if granted, the variance will not unreasonably diminish established property values <br /> within the neighborhood. <br /> <br />20.
