Councilmember Hendriksen introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #02-02-056 <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT #0602 TO REZONE CERTAIN <br />PROPERTY FROM B-1 BUSINESS TO I - INDUSTRIAL <br /> <br /> WHEREAS, the City received an application to rezone certain property in accordance <br />with Section 9.03.03 of the Ramsey City Code; and <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That J.R. Land and Cattle Company, hereinafter referred to as "Applicant", has properly <br />applied to rezone the following legally described property from B-1 Business to I- <br />Industrial: <br /> <br />That part of the Northwest Quarter of the Northwest Quarter of Section, 19, <br />Township 32, Range 25, Anoka County, Minnesota, lying southwesterly of the <br />southwesterly property line of the Burlington Northern Santa Fe Railroad <br />Company property. <br /> <br />That the Planning Commission conducted a public hearing pursuant to Section 9.03.03 of <br />the City Code on February 7, 2002, and that said public hearing was properly advertised <br />and that the minutes of said public hearing are hereby incorporated by reference. <br /> <br />That the total area of the Subject Property to be rezoned is approximately 17.29 acres in <br />size. <br /> <br />4. That the Applicant is proposing to rezone the Subject Property to I- Industrial. <br /> <br />That property to the south is zoned B-1 Business and property to the northeast is zoned <br />PUD, Planned Unit Development and to the west the Subject Property abuts the City of <br />Elk River. <br /> <br />That the 2001 Comprehensive Plan designates the Subject Property for Places to Shop <br />and therefore a Comprehensive Plan Amendment will be required. <br /> <br />That the Applicant submitted an application for an amendment to the 2001 <br />Comprehensive Plan on January 15, 2001 requesting that the land use designation in the <br />2001 Comprehensive Plan be changed from Places to Shop to Places to Work. <br /> <br />That the Applicant has submitted a general development plan that proposes to develop the <br />property with office/warehouse and outside storage activities. <br /> <br />That the proposed zoning amendment will not substantially adversely impair the use or <br />market value of any surrounding property. <br /> <br />10. That the proposed zoning amendment will not change the essential character of the area. <br /> <br /> <br />
