WHEREAS, on December 18, 2001, the City Council adopted an update of the City Comprehensive Plan that included an expansion of the Metropolitan Urban Service Area boundary to include the Subject Property; and WHEREAS, on January 4, 2002, the Planning Commission conducted a public hearing, on the proposed preliminary plat and recommended City Council approval of same. WHEREAS, on January 22, 2002, the Ramsey City Council adopted Ordinance #02-02 to rezone the Subject Property from R-1 Rural Residential to R-1 Urban Residential and granted preliminary plat approval to the Subject Property; and WHEREAS, the City received the proposed final plat on February 27, 2002. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) 2) That the Ramsey City Council hereby grants final plat approval to River Pines 5th Addition contingent upon compliance with City Staff review letter dated March 7, 2002, and upon completion of a sound study to determine the necessity of Developer installed sound mitigation measures. That this final plat approval is contingent upon the Developer entering into a Development Agreement with the City. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Anderson, and upon vote being taken thereon, the following voted in favor thereof: Mayor Gamec Councilmember Kurak Councilmember Anderson and the following voted against the same: Councilmember Hendriksen Councilmember Zimmerman and the following abstained: None and the following were absent: None RESOLUTION #02-03-076 Page 2 of 3
