Chairperson Nixt introduced the following resolution and moved for its adoption: RESOLUTION #02-04-087B A RESOLUTION DENYING THE ISSUANCE OF A VARIANCE AND DECLARING TERMS OF SAME. WHEREAS, Edina Development (Permittee) has properly applied for a variance from the front yard or structure setback from public street requirement in the R-3 Urban Residential District on the property generally located west of T.H. #47 and north of Alpine Drive N.W. and legally described as follows: The West-half of the Northwest Quarter of Section 24, Township 32, Range, 25, Anoka County, Minnesota lying Westerly to the centerline of State Trunk Highway Number 47 as now laid out and traveled and Northerly of the South 413.75 feet of the West-half of the Northwest Quarter of said survey. Or upon platting and recording: Evergreen Point, Anoka County, Minnesota (the "Subject Property"); and WHEREAS, the Board of Adjustment met on April 4, 2002, conducted the public hearing and adopted findings of fact relating to the request for a variance from the front yard setback requirements on the Subject Property. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows Based on Findings of Fact #0605, a 25-foot variance from the front yard setback height restrictions is hereby denied. The motion for the adoption of the foregoing resolution was duly seconded by Board Member Reeve, and upon vote being taken thereon, the following voted in favor thereof: Chairperson Nixt Board Member Reeve Board Member Brauer Board Member Kociscak Board Member Sweet Board Member Watson
