That it will be extremely difficult for parcels guided for medium and high density residential <br />development in the 2001 Comprehensive Plan to achieve the densities prescribed in the <br />Comprehensive Plan if the front yard structure setback from public roads is not adjusted. <br /> <br />9. That the City of Ramsey is currently considering amendments to Chapter 9, the Zoning and <br /> Subdivision Code. <br /> <br />10. That one of the amendments will change the required front yard setback for townhouse units <br /> to 25 feet from the edge of the public right-of-way. <br /> <br />11. That the proposed variance, if approved, will comply with the new proposed codes governing <br /> front yard setbacks in townhome developments. <br /> <br />12. That the special conditions causing the undue hardship do/do not result from the actions of <br /> the Applicant. <br /> <br />13. That if granted, the variance will not grant the Applicant any special privilege that is denied <br /> to other owners of lands, structures or buildings in the same district. <br /> <br />14. That if granted, the variance will not be materially detrimental to the purposes of the Ramsey <br /> Zoning Chapter or other property in the R-3 Urban Residential District. <br /> <br />15. That if granted, the variance will not substantially increase the congestion of public streets, or <br /> increase the danger of fire, or endanger the public safety, or substantially impair property <br /> values within the neighborhood. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Chairperson Nixt, <br />and upon vote being taken thereon, the following voted in favor thereof: <br /> <br /> Chairperson Nixt <br /> Board Member Johnson <br /> Board Member Kociscak <br /> <br />and the following voted against the same: <br /> <br /> Board Member Brauer <br /> <br />and the following abstained: <br /> <br /> None <br /> <br />and the following were absent: <br /> <br /> Board Member Reeve <br /> Board Member Sweet <br /> Board Member Watson <br /> <br />Resolution #02-05-102 <br />Page 2 of 3 <br /> <br /> <br />
