749350 <br /> <br />Board Member Johnson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #02-05-103 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO THE FRONT <br />YARD SETBACK IN THE PROPOSED PLAT OF EVERGREEN POINT AND <br />DECLARING TERMS OF SAME. <br /> <br /> WHEREAS, Edina Development (Permittee) has properly applied for a variance from <br />the front yard or structure setback from public street requirement in the R-3 Urban Residential <br />District on the property generally located west of T.H. #47 and north of Alpine Drive N.W. and <br />legally described as follows: <br /> <br />The West-half of the Northwest Quarter of Section 24, Township 32, Range, 25, Anoka <br />County, Minnesota lying Westerly to the centerline of State Trunk Highway Number 47 <br />as now laid out and traveled and Northerly of the South 413.75 feet of the West-half of <br />the Northwest Quarter of said survey. <br /> <br />Or upon platting and recording: <br /> <br /> Evergreen Point, Anoka COunty, Minnesota <br />(the "Subject Pr3perty"); and <br /> <br /> WHEREAS, the Board of Adjustment met on May 2, 2002, conducted the public hearing <br />and adopted findings of fact relating to the request for a variance from the from yard setback <br />requirements on the Subject Property. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows <br /> <br />Based on Findings of Fact #0607, a variance to the thirty-five (35) foot front yard setback <br />requirement on public streets, as established in Section 9.20.14 of the Ramsey City Code, <br />is hereby granted for the development of the Subject Property with townhomes at a net <br />density not to exceed 7 units per acre. <br /> <br />All of the buildings constructed adjacent to the public streets on the Subject Property to <br />which the front yard setback of thirty-five (35) feet is applicable shall maintain a <br />minimum of a twenty-five (25) foot setback from the right-of-way. <br /> <br /> <br />
