Board Member Kociscak introduced the following resolution and moved for its adoption: RESOLUTION #02-05-105 A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO THE FRONT YARD SETBACK IN THE PROPOSED PLAT OF ALPINE MEADOWS AND DECLARING TERMS OF SAME. WHEREAS, Eighty-Seven, LLC (Permittee) has properly applied for a variance from the front yard or structure setback from public street requirement in the R-3 Urban Residential District on the property generally located west of T.H. #47 and south of Alpine Drive N.W. and legally described as follows: Outlot A, Brandseth Addition, Anoka County, Minnesota Or upon platting and recording: Alpine Meadows, Anoka County, Minnesota (the "Subject Property"); and WHEREAS, the Board of Adjustment met on May 2, 2002, conducted the public hearing and adopted findings of fact relating to the request for a variance frOm the front yard setback requirements on the Subject Property. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows Based on Findings of Fact #0608, a variance to the thirty-five (35) foot front yard setback requirement on public streets, as established in Section 9.20.14 of the Ramsey City Code, is hereby granted for the development of the Subject Property with townhomes at a net density not to exceed 7 units per acre. All of the buildings constructed adjacent to the public streets on the Subject Property to which the front yard setback of thirty-five (35) feet is applicable shall maintain a minimum of a twenty-five (25) foot setback from the right-of-way. No construction shall commence without site plan approval and the issuance of a building permit.
