Board Member Brauer introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #02-05-106 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0609 RELATING TO A <br />REQUEST FOR A VARIANCE FROM FRONT YARD SETBACK REQUIREMENTS IN <br />THE R-3 URBAN RESIDENTIAL DISTRICT <br /> <br /> WHEREAS, Eighty-Seven LLC, hereinafter referred to as "Applicant", has properly <br />applied for a Board of Adjustment variance to the cul-de-sac length of 600 feet established in <br />Section 9.50.30, Subd. 3(g) of the Ramsey City Code on the property generally located west of <br />St. Francis Blvd. N.W. and south of Alpine Drive, and legally described as follows: <br /> <br />Outlot A, Brandseth Addition, Anoka County, Minnesota <br /> <br />(the "Subject Property") <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Board of Adjustment for a public hearing pursuant to <br />Section 9.03.05 of the Ramsey City Code on May 2, 2002, and that said public hearing was <br />properly advertised and that the minutes of said public hearing are hereby incorporated as a <br />part of these findings by reference. <br /> <br />2. That the Subject Property is zoned R-3 Urban Residential and the Applicant has made proper <br /> application to the City to develop the Subject Property with 42 townhome units. <br /> <br />3. That Section 9.50.30, Subd. 3(g) of the City Code limits the length of cul-de-sac to 600 feet. <br /> <br />4. That Section 9.50.30, Subd. 2(b) of the City Code requires new subdivisions to make <br /> provisions for the continuation of existing streets into adjoining areas. <br /> <br />That the applicant is proposing to construct a segment of public street approximately 850 feet <br />in length to reach the southern edge of the Subject Property and that will terminate in a <br />temporary cul-de-sac. <br /> <br />6. That due to its unique shape and location, the property cannot meet the intent of Section <br /> 9.50.30 Subd. 2(b) without exceeding the 600-foot cul-de-sac limit. <br /> <br />7. That the special conditions causing the undue hardship do not result from the actions of the <br /> Applicant. <br /> <br />8. That if granted, the variance will not grant the Applicant any special privilege that is denied <br /> to other owners of lands, structures or buildings in the same district. <br /> <br /> <br />
