Councilmember Zimmerman introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION//02-05-112 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT //0610 RELATING TO A <br />REQUEST TO EXCEED OUTDOOR STORAGE RESTRICTIONS ESTABLISHED IN <br />THE BUSINESS WAREHOUSE DISTRICT. <br /> <br /> WHEREAS, T & G Land Inc., hereinafter referred to as "Applicant", has properly <br />applied to the City of Ramsey (the "City") for a conditional use permit to exceed outdoor storage <br />restrictions established in City Code on the property located at 6651 141st Avenue and legally <br />described as follows: <br /> <br />Lot 1, Block 1, Gateway North Industrial Park No. 5, Anoka County, Minnesota. <br /> <br />("Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Planning Commission for a public hearing pursuant <br />to Section 9.03.04 of the Ramsey City Code on May 2, 2002, and that the public hearing was <br />properly advertised and that the minutes of said public hearing are hereby incorporated by <br />reference. <br /> <br />That the Subject Property is zoned BW - Business Warehouse; the adjacent parcels to the <br />north and west are zoned BW - Business Warehouse; property to the east is zoned I - <br />Industrial. <br /> <br />3. That the permitted uses in the BW - Business Warehouse District include office and <br /> warehousing activities. <br /> <br />That the permitted accessory uses in the BW - Business Warehouse District restricts outside <br />storage areas to 10% of the Subject Property, which equates to 1.12 acres (48,961 square <br />feet) on the 11.24 acre (489,614 square feet) Subject Property. <br /> <br />That the Applicant is requesting to exceed the 10% allowable outdoor storage area by 21%, <br />for a total outside storage area equaling 31% of the Subject Property, or 3.5 acres (153,475 <br />square feet). <br /> <br />6. That the outdoor storage area will be contained within the existing bituminous or aggregate <br /> surfaced areas on the Subject Property. <br /> <br />7. That the proposed use will not adversely impact traffic in the area. <br /> <br />8. That the proposed use will not be dangerous or detrimental to persons residing or working in <br /> the vicinity of the use or to the public welfare. <br /> <br />9. That the proposed use will not substantially or adversely impair the use, enjoyment or market <br /> value of surrounding properties. <br /> <br />10. <br /> <br />That the proposed use will be operated and maintained so as to be harmonious and <br />appropriate in appearance with the existing or intended character of the general vicinity and <br />such use will not change the essential character of the area. <br /> <br />11. That the proposed use will not create additional requirements at public cost for public <br /> facilities and services. <br /> <br />12. That the proposed use will not be detrimental to the economic welfare of the community. <br /> <br /> <br />
