Councilmember Zimmerman introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION 02-05-115 <br /> <br />A RESOLUTION APPROVING A ONE YEAR EXTENSION TO INITIATE THE <br />CONDITIONAL USE PERMIT ISSUED TO SAINT PAUL TERMINALS, INC. FOR A <br />RECYCLING FACILITY. <br /> <br /> WHEREAS, the Ramsey City Council (the "City") adopted Resolution/tO 1-06-240 adopting <br />Findings of Fact/10562 relating to a request from St. Paul Terminals for a conditional use permit to <br />establish a recycling facility; and <br /> <br /> WHEREAS, on June 26, 2001, the Ramsey City Council approved the request for a <br />conditional use permit for a recycling facility and adopted Resolution/tO 1-06-241 declaring terms <br />of same; and <br /> <br /> WHEREAS, the Section 9.03.04 of the Ramsey City Code states that a conditional use <br />permit shall expire if the permit holder fails to initiate such conditional use permit and fulfill each <br />and every condition attached thereto within one (1) year from the date of its authorization,, or if the <br />use is discontinued for a continuous twelve (12) month period, unless a petition for an extension of <br />time in which to complete or utilize the use that has been granted by the Council; and <br /> <br /> WHEREAS, the City of Ramsey received a letter from the Permit Holder's representative, <br />Bradley Martinson of Bradley J. Martinson Law Offices, dated March 20, 2002, in which it is stated <br />that due to economic conditions the Permit Holder has not been able to initiate the conditional use <br />permit and therein requests an extension of time. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That a one year extension to June 26, 2003, is herein granted to the Permit Holder to <br />initiate the conditional use permit for a recycling facility on the property legally <br />described as follows: <br /> <br />Lot 1 and Lot 2 (except the south 30 feet of Lot 2), Block 4, Gateway Industrial Park <br />Plat 2, County of Anoka, State of Minnesota <br /> <br />Upon written notice being provided by the City to the Permit Holder but without <br />further action by the Planning Commission or Council, this Permit extension shall <br />expire if the Permit Holder fails to initiate such extended conditional use permit and <br />fulfill each and every condition attached thereto by June 26, 2003, unless a petition <br />for an extension of time in which to complete or utilize the use that has been granted <br />by the City Council Such extension shall be requested in writing and filed with the <br />City at least thirty (30) days before June 26, 2003. <br /> <br /> <br />
