Chairperson Nixt introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #02-06-130 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0615 RELATING TO A <br />REQUEST FOR A VARIANCE FROM CUL-DE-SAC LENGTH RESTRICTION IN <br />SECTION 9.50.30 SUBD. 3 (G) OF CITY CODE <br /> <br /> WHEREAS, Royal Oaks Realty, Inc. hereinafter referred to as "Applicant", has properly <br />applied for a Board of Adjustment variance to the cul-de-sac length of 600 feet established in <br />Section 9.50.30, Sub& 3(g) of the Ramsey City Code on the property generally located west of <br />St. Francis Blvd. N.W. and south of Alpine Drive, and legally described as follows: <br /> <br /> Outlot B of The Ponds, Anoka County, Minnesota; <br /> <br /> and <br /> <br /> Outlots A and B of Wood Pond Hills 4th Addition, Anoka County, Minnesota <br /> <br />OF <br /> <br />1. <br /> <br />o <br /> <br />o <br /> <br />(the "Subject Property") <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Applicant appeared before the Board of Adjustment for a public hearing pursuant to <br />Section 9.03.05 of the Ramsey City Code on June 6, 2002, and that said public hearing was <br />properly advertised and that the minutes of said public hearing are hereby incorporated as a <br />part of these findings by reference. <br /> <br />That the Subject Property is zoned R~IU Urban Residential and the Applicant has made <br />proper application to the City to develop the Subject Property with 7 single family units. <br /> <br />That Section 9.50.30, Subd. 3(g) of the City Code limits the length of cul-de-sac to 600 feet. <br /> <br />That the applicant is proposing to construct a segment of public street approximately 240 feet <br />to make the total length of 145t~ Court 840 feet in length to reach the southwestern edge of <br />the peninsula where the Subject Property is located. <br /> <br />That due to its unique shape and location, the property cannot meet the intent of Section <br />9.50.30 Subd. 2(b) without exceeding the 600-foot cul-de-sac limit. <br /> <br />That the special conditions causing the undue hardship do not result from the actions of the <br />Applicant. <br /> <br />That if granted, the variance will not grant the Applicant any special privilege that is denied <br />to other owners of lands, structures or buildings in the same district. <br /> <br /> <br />
