Chairperson Nixt introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #02-06-136 <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT #0618 RELATING TO A REQUEST <br />FOR A VARIANCE TO THE SIDE YARD SETBACK ON A CORNER LOT AT 15920 <br />RADIUM ST. N.W. <br /> <br /> WHEREAS, Geno and Laurie Ronallo, hereinafter referred to as "Applicants," have <br />properly applied for a variance from Section 9.11.02 of the Ramsey City Code to construct a <br />garage that will encroach on the side yard setback for a comer lot on the property generally <br />known as 15920 Radium St. N.W. and legally described as follows: <br /> <br />Lot 5, Block 3, Hall Anderson Acres, Anoka County, Minnesota <br />(the "Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.05 of the <br />Ramsey City Code on June 6, 2002, and that said public hearing was properly advertised, and <br />that the minutes of said public hearing are hereby incorporated as a part of these findings by <br />reference. <br /> <br />2. That the Subject Property is zoned R-1 Rural Residential and is approximately .9 acres in <br /> size. <br /> <br />3. That the Subject Property is surrounded by R-1 Rural Residential zoning developed with <br /> single family homes. <br /> <br />4. That Section 9.20.11 of the Ramsey City Code establishes a side yard setback on comer lots <br /> of 35 feet, or conform to adjacent setbacks, whichever is greater. <br /> <br />That the yard adjacent to 159th Lane N.W. is considered the Applicant's side yard and the <br />principal structure on the adjacent property to the west is approximately 50 feet from their <br />front property line or the right-of-way of 159th Lane N.W. <br /> <br />That the Applicants are proposing to construct a garage approximately 26 feet from their <br />south side property line or the right-of-line of 159th Lane N.W.; this would require a 24 foot <br />variance to the 50 foot setback, as established by the location of the principal structure on the <br />adjacent property to the west. <br /> <br />That the City Code allows for a total of 1,488 square feet of garage and accessory buildings <br />on the Subject Property; there is an existing 440 square foot garage; a 192 square foot storge <br />shed; the proposed garage will be 780 square feet; this totals 1,412 square feet, which is in <br />compliance with City Code. <br /> <br /> <br />
