Councilmember Gamec introduced the following resolution and moved for its adoption. <br /> <br />RESOLUTION #02-07-178 <br /> <br />RESOLUTION AUTHORIZING EMINENT DOMAIN TO ACQUIRE TRAIL <br />EASEMENT <br /> <br /> WHEREAS, the City of Ramsey desires to construct trail for safety and <br />recreational purposes along Alpine Drive from T.H.//47 to Roanoke Street; and <br /> <br /> WHEREAS, the width of existing fight-of-way is too narrow to accommodate the <br />proposed eight foot bituminous trail on the southern side of Alpine Drive between T.H. <br />//47 and Zuni Street NW; and <br /> <br /> WHEREAS, the TH 47 Access and Corridor Study which was adopted by the <br />City Council identifies the location of 164th Lane as the only permissible access point to <br />the TH 47, which is feasible to provide access to Elmcrest Park; and <br /> <br /> WHEREAS, the City has the authority to acquire real property for Public <br />Improvements by eminent domain pursuant to Minnesota Statutes Chapter 117 and <br />pursuant to City Charter; and <br /> <br /> WHEREAS, the City has the fight to acquire the real property prior to the filing <br />of an award by the Court appointed commissioners, pursuant to Minnesota Statutes <br />117.011 and 117.042; and <br /> <br /> WHEREAS, the real property which needs to be acquired to provide a trail <br />easement is legally described as follows: <br /> <br /> Permanent easement for trail purposes <br />The north 15 feet of Lot 1 Blk 3 Gorhams Sandy Acres Estates <br /> <br /> Temporary construction easement <br />The south 10 feet of the north 25 feet of Lot 1 Blk 3 Gorhams Sandy Acres Estates. <br />Said temporary construction easement to expire on May 1, 2003 <br /> <br />WHEREAS, the property owner of the real property which needs to be acquired <br /> has been identified by the City as follows: <br /> <br />Charles Pratley, 15252 Zuni Street NW <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the City Administrator is hereby directed to acquire the real property as <br />described above in accordance with Minnesota Statutes. The City Administrator <br />is authorized to negotiate and represent the City of Ramsey in all proceedings. <br /> <br />That if the real property as described above cannot be <br />negotiation, it shall be acquired by eminent domain. <br /> 02-07-178 <br /> <br />acquired by direct <br /> <br /> <br />
