Board Member Johnson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #02-08-199 <br /> <br />RESOLUTION ADOPTING FINDINGS OF FACT #0626 RELATING TO A REQUEST <br />FOR A VARIANCE TO THE 20 FOOT LANDSCAPE REQUIREMENT ADJACENT TO <br />PUBLIC ROADS. <br /> <br /> WHEREAS, Fariborz Yamoutpour, hereinafter referred to as "Applicant," has properly <br />applied for a variance from Section 9.11.09 regarding landscape requirements adjacent to public <br />roads for the proposed development on the property generally located at the intersection of U.S. <br />Highway #10 and County Road 57 (Sunfish Lake Blvd) and legally described as follows: <br /> <br />Lot 2, Block 1, Sunfish Commons, Anoka County, Minnesota. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That the Board of Adjustment conducted a public hearing pursuant to Section 9.03.05 of the <br />Ramsey City Code on August 29, 2002, and that said public hearing was properly advertised, <br />and that the minutes of said public hearing are hereby incorporated as a part of these findings <br />by reference. <br /> <br />2. That the subject property is zoned B-3 Highway Business and is approximately 1.6 acres in <br /> size. <br /> <br />3. That properties to the south, east, and west are zoned B-3 Highway Business and property to <br /> the north is zoned Industrial. <br /> <br />4. That section 9.11.09 (Performance Standards, Screening) requires a twenty (20) foot wide <br /> landscaped area adjacent to all public streets. <br /> <br />o <br /> <br />That the Applicant is requesting the 20~foot landscape requirement along Sunfish Lake Blvd. <br />be waived in order to provide the minimum maneuvering area needed to allow for a safe and <br />comfortable access to the convenience gas store, fast food, and car wash facility. <br /> <br />6. That the Applicant has stated the variance requested is the minimum variance needed to <br /> alleviate the hardship. <br /> <br />7. That if granted, the variance will permit a use that is prohibited in the B-3 Highway Business <br /> District. <br /> <br />8. That if granted, the variance will impair an adequate supply of light and air to adjacent <br /> property. <br /> <br /> <br />
