Board Member Johnson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #02-08-200 <br /> <br />A RESOLUTION DENYING THE ISSUANCE OF A VARIANCE AND DECLARING <br />TERMS OF SAME. <br /> <br /> WHEREAS, Fariborz Yamoutpour (Permittee) has properly applied for a variance from <br />the landscape equirements adjacent to public roads on the property generally located at the <br />intersection of U.S. Highway #10 and County Road #57 (Sunfish Lake Blvd.) and legally <br />described as follows: <br /> <br />Lot 2, Block 1, Sunfish Commons, Anoka County, Minnesota <br /> <br />(the "Subject Property"); and <br /> <br /> WHEREAS, the Board of Adjustment met on August 29, 2002, conducted the public <br />hearing and adopted findings of fact relating to the request for a variance from landscape <br />requirements along the eastern property line of the Subject Property, adjacent to County Road <br />#57 (Sunfish Lake Blvd.). <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT <br />OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows <br /> <br />Based on Findings of Fact #0626, a variance to the landscape requirements adjacent to <br />public roads, as established in Section 9.11.09 of the Ramsey City Code, is hereby denied <br />for the development of a convenience gas station, car wash, and fast food facility on the <br />Subject Property. <br /> <br />The Permittee shall be responsible for all City costs incurred in processing the variance <br />request. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Chairperson Nixt, <br />and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Chairperson Nixt <br />Board Member Johnson <br />Board Member Kociscak <br />Board Member Reeve <br />Board Member Watson <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br /> <br />
