REC'D JAN 1 ? 2003 <br /> <br />Councilmember Zimmerman introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #02-09-230 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />TO WAYNE AND PAMELA STEINKE TO EXCEED THE HEIGHT AND SIZE <br />RESTRICTIONS FOR DETACHED ACCESSORY BUILDINGS ON PROPERTIES <br />LOCATED WITHIN THE METROPOLITAN URBAN SERVICE AREA (MUSA) AND <br />DECLARING TERMS OF SAME: <br /> <br /> WHEREAS, Wayne and Pamela Steinke (Permittees) have properly applied for a <br />conditional use permit to exceed the detached accessory building height and size restrictions for <br />properties located within the Metropolitan Urban Service Area (MUSA) established in section <br />9.11.02 "Accessory Uses" of City Code on the property generally known as 15661 Juniper Ridge <br />Drive N.W. and legally described as follows: <br /> <br />Lot 5, Block 1, Reilley Estates, Anoka County, Minnesota <br /> <br />(Subject Property) <br /> <br />1732053 <br /> <br /> WHEREAS, the Planning Commission met on August 1, 2002, conducted the <br />public hearing and recommended City Council approval of the request. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact #0629, a Conditional Use Permit (Permit) to exceed the detached <br />accessory building height and size restrictions for properties located within the MusA as <br />established in City Code, is hereby granted to Wayne and Pamela Steinke, hereinafter <br />referred to as the "Permittees". <br /> <br />That the detached accessory building may exceed the sixteen (16) foot detached accessory <br />building height restriction for properties located within the Metropolitan Urban Service Area <br />by a total of 6 feet 6 inches in order to match the design and height of the dwelling on the <br />Subject Property. <br /> <br />3. That the detached accessory building constructed on the property shall not exceed 768 square <br /> feet in size, which exceeds the 1,488 square foot limit on the property by 40 square feet. <br /> <br />4. That the Permittee herein agrees that no other accessory buildings, including garden or <br /> storage sheds shall be erected on the Subject Property. <br /> <br /> <br />
