Councilmember Hendriksen introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION/402-09-231 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0630 RELATING TO A <br />REQUEST FOR A CONDITIONAL USE PERMIT FROM WILLIAM AND ELIZABETH <br />ERHART TO EXCEED HEIGHT RESTRICTIONS FOR A DETACHED ACCESSORY <br />BUILDING ON PROPERTY LOCATED WITHIN THE METROPOLITAN URBAN <br />SERVICE AREA. <br /> <br /> WHEREAS, William and Elizabeth Erhart, hereinafter referred to as the "Applicants," <br />have properly applied for a Conditional Use Permit to exceed the height and size restrictions for <br />detached accessory buildings on properties located in the Metropolitan Urban Service Area <br />(MUSA) on the property generally known as 4740 154th Lane and legally described as follows: <br /> <br />Lot 11, Block 1, Stanhope River Hills, Anoka County, Minnesota <br /> <br />("Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br />That the Applicants appeared before the Planning Commission for a public hearing pursuant <br />to Section 9.03.04 of the Ramsey City Code on August 29, 2002, and that said public hearing <br />was properly advertised and that the minutes of said public hearing are hereby incorporated <br />by reference. <br /> <br />2. That the Subject Property is zoned R-1 Residential and is located within the Metropolitan <br /> Urban Service Area (MUSA). <br /> <br />3. That the Subject Property is approximately 4.5 acres in size. <br /> <br />4. That City Code restricts detached accessory building height to sixteen (16) feet on properties <br /> that are located within the Metropolitan Urban Service Area (MUSA). <br /> <br />5. That the Applicants would like to construct an accessory building that will be approximately <br /> 22 feet in height. <br /> <br />6. That City Code restricts the Subject Property to a total of 2,864 square feet of accessory <br /> building space. <br /> <br />That the Applicants have a primary garage of 1,224 square feet; the new accessory building is <br />proposed to be 1,584 square feet in size; resulting in a total of 2,808 square feet of accessory <br />building on the Subject Property. <br /> <br />8. That the Applicant has stated that the reasons for the excess height on the proposed building <br /> is threefold: a) to match the architecture style of the principal dwelling on the Subject <br /> <br /> <br />
